Maharashtra Court Takes Action Against Police Over Alleged Mistreatment of ZP Members
A magisterial court in Mahabaleshwar, Satara district, has taken significant action regarding the controversial arrest of two Satara Zilla Parishad (ZP) members. On Wednesday, Judicial Magistrate First Class (JMFC) Uday S Ivare directed that a show-cause notice be issued to the Mahabaleshwar police concerning allegations of ill-treatment against the arrested officials.
Arrests That Shook Local Politics
The case centers around the arrest of two NCP ZP members, Anil Desai and Sandip Mandave, on March 20. They were detained just feet away from the entrance of the ZP hall where voting was scheduled to elect the president and vice-president. This police action proved politically consequential, as the Shiv Sena-NCP alliance lost both ZP posts to the BJP despite holding a numerical majority. The arrests effectively reduced their voting strength at a critical moment.
Medical Evidence and Judicial Observations
Magistrate Ivare's decision came after reviewing a medical report that revealed injury marks on the arrested members, providing prima facie support for their allegations of mistreatment. The court rejected the police's request for custodial remand and instead granted bail to Desai and Mandave. In a significant observation, the magistrate stated that custodial interrogation cannot be permitted at the expense of the fundamental rights of the accused.
The magistrate further noted that the alleged abduction victim did not support the police's version of events, adding another layer of complexity to the case.
Detailed Allegations of Police Misconduct
Anil Desai provided a harrowing account to reporters in Satara, describing severe treatment at the hands of authorities. "We were beaten badly by police in plainclothes," Desai stated. "They confiscated our cellphones, forced us into a police van, and transported us between locations for hours before finally bringing us to the Mahabaleshwar police station in the evening. We went without food for the entire day and have visible injury marks from the beating. We are currently seeking legal counsel to file a formal case against the involved officers."
Additional Testimony Undermines Police Case
During court proceedings, Dinkar alias Bapusaheb Shinde, another NCP member, testified that his son was pressured by police into filing an abduction complaint. Despite his son's statement to police that no abduction occurred, authorities proceeded to register an FIR against Desai and Mandave based on this coerced complaint.
Police Justification and Investigation Transfer
The Mahabaleshwar police have maintained in their report to the State Intelligence Department that both ZP members expressed intentions to disrupt the voting process while en route to the hall, allegedly because they anticipated electoral defeat. The case has since been transferred from the Mahabaleshwar police to the local crime branch for further investigation.
This development highlights ongoing tensions between law enforcement and political representatives in Maharashtra, with the court's intervention signaling serious judicial scrutiny of police conduct in politically sensitive cases.
