This order was passed by a division bench comprising Chief Justice MS Sonak and Justice Rajesh Shankar during a hearing on Thursday.
Public Interest Litigation Spurs Judicial Scrutiny
The court was addressing a public interest litigation (PIL) filed by Onkar Vishwakarma, which highlighted the urgent need for functional burn wards in government hospitals across all districts of the state. The PIL emphasized the critical importance of accessible burn care facilities for public health and safety.
Government's Claims and Counterarguments
During the proceedings, the government counsel informed the high court that burn wards have been established in all government hospitals and medical colleges throughout Jharkhand. The counsel asserted that the necessary infrastructure for establishing and operating these burn units has been commissioned and is under continuous monitoring. Additionally, it was stated that adequate medical personnel required to run the burn units successfully have been hired.
However, amicus curiae advocate Diksha Dwivedi presented a contrasting perspective before the bench. Dwivedi argued that there is a significant shortage of medical specialists in some burn units within government hospitals. She referenced a chart submitted by the government during an earlier hearing in the case, which indicated that only four districts had burn units equipped with satisfactory equipment and personnel. Dwivedi further noted that the government's claims did not explicitly mention the establishment of burn units in all government hospitals, raising concerns about the comprehensiveness of their implementation.
