Navsari Court Begins Hearing Discharge Application in Khergam Violence Case

A court in Navsari, Gujarat, has commenced proceedings on the discharge application filed by Vansda MLA Anant Patel and several other political activists. The application pertains to the 2022 Khergam violence case, which has drawn significant attention due to the serious allegations involved.

Background of the Case and Key Allegations

The case stems from an incident on October 8, 2022, when Anant Patel, along with other political leaders and a mob of approximately 50 individuals, allegedly attacked a tea stall owned by Bhikhu Ahir in Khergam. The accusations include setting the stall on fire and stealing Rs 1.5 lakh in cash, with total property damage estimated at Rs 8-10 lakh.

Further complicating the situation, when a fire brigade vehicle arrived to extinguish the blaze, a larger mob of 70-100 people reportedly obstructed it. Fireman Harsad Pawar was assaulted, and the vehicle sustained damage. The mob also attacked police personnel and damaged four government vehicles.

Legal Proceedings and Recent Developments

In response to the incident, three FIRs were registered at the Khergam police station against 26 persons, including Patel. The complaints were filed by Bhikhu Ahir's wife, the fire department, and the police.

During the hearing on Tuesday, Anant Patel and the other political activists, Shashin Patel and Zarna Patel, were absent. Consequently, the Gujarat government, represented by special public prosecutor Nayan Sukhadwala, filed a warrant application. Sukhadwala expressed skepticism, stating, "It seems the discharge application is just a ploy to buy time. There is no strong reason in the application and the accused just expressed that they are innocent."

However, Patel's advocate, Paresh Vatvecha, countered that the warrant application was rejected by the court. Vatvecha explained, "My clients have not been able to be present due to unavoidable circumstances. There is no visible proof that Patel was involved in the violence." He further claimed that Patel and others were engaged in a 'satyagrah' after Patel was attacked by former district panchayat president Bhikhu Ahir, and instead of registering Patel's case, three FIRs were filed against him.

Next Steps and Implications

The court has scheduled the next hearing for April 9. The outcome of the discharge application could have significant implications for the accused, potentially affecting their political careers and legal standing. The case highlights ongoing tensions in the region and underscores the complexities of legal proceedings involving public figures.

As the hearing progresses, stakeholders are closely monitoring developments, with the prosecution emphasizing the need for accountability and the defense maintaining the innocence of the accused. The appointment of a special public prosecutor indicates the government's commitment to pursuing the case rigorously.
