A vacation bench headed by Justice L Victoria Gowri is scheduled to hear the plea in a special sitting on Sunday.
Background of the Election
In the recently concluded assembly elections, Periyakaruppan contested from the Tiruppathur constituency in Sivaganga district on behalf of the Dravida Munnetra Kazhagam (DMK). His rival, TVK candidate Srinivasa Sethupathi, secured 83,365 votes and was declared elected. Periyakaruppan secured 83,364 votes and was declared defeated by a razor-thin margin of one vote.
Legal Action and Hearing
While the Tamil Nadu governor has invited actor-turned-politician and TVK founder Vijay to form the government on Sunday, Periyakaruppan has filed a petition seeking a recount of votes. Additionally, he has sought an interim order restraining Srinivasa Sethupathi from taking oath as an MLA. The petition is listed for hearing on Sunday before a vacation bench comprising Justice L Victoria Gowri and Justice N Senthilkumar.
