Supreme Court Stays Delhi HC Order on CBI Chargesheet Sanction Against Mahua Moitra
SC Stays Delhi HC Order on CBI Chargesheet Against Mahua Moitra

Supreme Court Intervenes in Cash-for-Query Case Against TMC MP Mahua Moitra

The Supreme Court of India has taken a significant step in the ongoing cash-for-query controversy involving Trinamool Congress (TMC) MP Mahua Moitra. On Friday, a bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi issued a stay on a portion of the Delhi High Court's order that had previously quashed the sanction granted by the Lokpal to the Central Bureau of Investigation (CBI) for filing a chargesheet against Moitra.

Legal Proceedings and Notices Issued

The apex court has issued formal notices to Mahua Moitra, the CBI, and BJP MP Nishikant Dubey, who filed the initial complaint. This action comes in response to a petition from the Lokpal challenging the Delhi High Court's December 19, 2025, judgment. The high court had set aside the Lokpal's November 12, 2025, decision to authorize the CBI to proceed with a chargesheet against Moitra, citing that separate sanctions for filing a charge sheet and initiating prosecution are not provided for under the Lokpal and LokAyuktas Act, 2013.

In its ruling, the Delhi High Court had directed the Lokpal to reconsider the grant of sanction under Section 20 of the Lokpal Act within one month, as outlined in paragraph 89 of the judgment. The Supreme Court has specifically stayed the directions contained in this paragraph, while also issuing notices on petitions that address the powers and procedures detailed in Section 20 of the 2013 Act.

Background of the Allegations

Mahua Moitra faces serious accusations of asking questions in the Lok Sabha in exchange for cash and gifts from a businessman. The case has drawn widespread attention due to its implications for parliamentary ethics and anti-corruption measures. The high court's verdict was delivered on Moitra's petition, which contested the Lokpal's sanction order. Following the high court's decision to set aside this order, the Lokpal escalated the matter to the Supreme Court, seeking clarity and enforcement of its authority under the Lokpal Act.

This legal battle underscores the complexities involved in interpreting anti-corruption legislation and the procedural requirements for prosecuting public officials. The Supreme Court's intervention highlights the judiciary's role in balancing investigative powers with legal safeguards, ensuring that due process is followed in high-profile cases.

The stay order marks a pivotal development, potentially allowing the CBI to resume its efforts to file a chargesheet pending further judicial review. As the case progresses, it will likely influence future applications of the Lokpal Act and set precedents for handling allegations of misconduct against Members of Parliament.
