Nagpur-Based Company Demands ₹50 Crore in Damages Over Alleged Defamatory Article
A significant legal confrontation has emerged in Nagpur as CIAN Agro Industries and Infrastructure Limited, a publicly listed company, has issued a formal legal notice seeking ₹50 crore in damages. The notice demands the immediate removal of an article published by a magazine that allegedly falsely connected the firm and its promoters to the beef trade.
Ownership and Allegations
The company is owned by Nikhil Gadkari, son of Union Transport Minister Nitin Gadkari. Through counsel Meera Kaura Patel, the legal notice was dispatched to the publication, various social media platforms, and regulatory bodies. It describes the article titled "Nagpur's Beef" as "defamatory, false, communally incendiary and malicious" and calls for its takedown within a strict 24-hour timeframe.
In addition to removal, the notice insists on a public apology and a binding commitment against any future publication of similar claims. The company has categorically denied any involvement in meat processing or exports, emphasizing its exclusive operations in the manufacturing and trading of agro-based commodities.
Core of the Dispute and Legal Arguments
At the heart of the dispute is the article's purported attempt to link CIAN Agro Industries with third-party entities. The legal notice argues that the publication relied heavily on unverified claims, particularly from an individual embroiled in a commercial dispute, and "amplifies his unverified claims without independent evidence." It further contends that the report itself acknowledges the absence of any wrongdoing by the company.
Labeling the article a "deliberate exercise in reputational sabotage," the company alleges it selectively assembled information to craft a false narrative. The use of "sensational and inflammatory" presentation is said to be designed to provoke public outrage. The notice specifically objects to the mention of beef, arguing it was intentionally included to "create communal outrage."
Legal Provisions and Broader Actions
The notice invokes several legal provisions, including those under the Bharatiya Nyaya Sanhita, the Information Technology Rules, and the norms established by the Press Council. It asserts that the publication constitutes criminal defamation, public mischief, and conduct prejudicial to social harmony.
Beyond targeting the publishers, the notice was also sent to social media platforms, demanding:
- Immediate removal of the content
- Preservation of relevant data
- Prevention of further circulation
The company has issued a stern warning that failure to comply will trigger simultaneous civil and criminal proceedings. These could include claims for damages, injunctions, and regulatory action.
Related Legal Action Involving Nitin Gadkari
In a related development, a ₹50 crore defamation suit was filed against a YouTuber for allegedly maligning Union Minister Nitin Gadkari's image through social media videos. Sources indicate the controversy stems from claims linking Gadkari to a beef sale case.
The BJP IT cell initiated legal action after these videos went viral approximately two months ago. A subsequent cyber cell probe registered a case and identified the accused as Mohan, who allegedly created the contentious content. The lawsuit follows findings uncovered during this investigation, according to officials.
