Delhi Court Imposes Life Sentence on Kashmiri Separatist Asiya Andrabi in UAPA Case
In a significant legal development, a Delhi court on Tuesday delivered a life imprisonment sentence to Kashmiri separatist leader and Dukhtaran-e-Millat chief, Asiya Andrabi, in a case registered under the Unlawful Activities (Prevention) Act (UAPA). The ruling underscores the judiciary's firm stance against activities deemed as threats to national security.
Associates Receive 30-Year Prison Terms
Alongside Andrabi, her two associates, Fehmeeda and Nasreen, were sentenced to 30 years in prison in the same case. The trio was convicted on January 14 under Sections 20, 38, and 39 of the UAPA, which pertain to involvement in unlawful activities and supporting terrorist organizations.
National Investigation Agency's Stance
The National Investigation Agency (NIA) had strongly advocated for life imprisonment for Andrabi during the sentencing arguments. The agency contended that she had actively waged war against India, emphasizing the necessity of sending a stern message that conspiring against the state would result in the harshest penalties. This position highlights the gravity with which authorities view such offenses.
Additional Convictions Under IPC Sections
Beyond the UAPA charges, the three individuals were also convicted under several sections of the Indian Penal Code (IPC). These include:
- 153A: Promoting enmity between different groups.
- 153B: Making imputations or assertions prejudicial to national integration.
- 120B: Criminal conspiracy.
- 505: Statements conducing to public mischief.
- 121A: Conspiracy to commit offenses against the state.
These convictions, as reported by PTI, reflect a comprehensive legal approach to addressing actions that undermine social harmony and national unity.
Sentencing Pronounced by Additional Sessions Judge
Additional Sessions Judge Chander Jit Singh presided over the case and announced the sentence after carefully considering arguments on the quantum of punishment. The decision follows a thorough judicial process, reinforcing the legal system's commitment to upholding the rule of law in matters of national security.
This case marks a pivotal moment in India's efforts to combat separatist activities, with the court's ruling aimed at deterring similar actions in the future. The sentences serve as a reminder of the severe consequences for those found guilty of conspiring against the nation's integrity.
