Mumbai Court Orders Transfer of Accused Cop to Mental Health Facility for Fitness Evaluation
A sessions court in Mumbai issued a significant order on Thursday, directing the transfer of dismissed Railway Protection Force (RPF) constable Chetansingh Choudhary to a mental health facility. Choudhary stands accused in a high-profile quadruple murder case that shocked the nation last year.
Court Seeks Specific Medical Opinion on Trial Fitness
The court has specifically requested expert medical opinion regarding whether Choudhary is fit or unfit to stand trial and whether he possesses the capability to conduct his own defence. This development follows Choudhary's bail plea, in which he claimed his mental health was deteriorating rapidly while in custody.
The judge explicitly ordered: "Jail superintendent of Thane Central Prison is hereby directed to refer and admit accused...Choudhary to Thane Mental Hospital for better management and care and treatment till further order." The court further mandated that the medical officer submit a treatment report every fifteen days to monitor progress.
Background of Mental Health Treatment and Allegations
This marks the second time Choudhary will receive treatment at Thane Mental Hospital. Last year, he spent several months at the same facility following what his defence described as a "panic mental attack" while in custody. The defence has presented a detailed argument regarding his mental state.
In his bail application, Choudhary's legal team asserted:
- He had no knowledge of the crimes due to "extreme mental strokes"
- He suffers from "haunted illusions of a ghostly world"
- He has no prior criminal history
- His wife and two children are "anxiously waiting" for his release
- His family believes he requires "love, need and care" for proper recovery
The Alleged Crimes and Current Trial Status
The case stems from horrific incidents on July 31, 2023, when Choudhary allegedly committed multiple murders aboard an express train between Vaitarna and Mira Road stations. According to prosecution accounts:
- He allegedly gunned down his senior officer, ASI Tikaram Meena
- He allegedly shot passenger Kadar Bhanpurwala
- He then moved to another coach, took passenger Syed Saifuddin to the pantry car and shot him
- He allegedly shot a third passenger, Asghar Shaikh
- Following the shootings, he reportedly delivered a communally charged speech
The trial has progressed with eighteen witnesses having already deposed before the court. Proceedings have been adjourned until April 8, allowing time for the mental health assessment to be completed and reported back to the court.
This case continues to draw significant attention due to both the severity of the alleged crimes and the complex mental health considerations now central to the legal proceedings. The court's decision reflects the judicial system's careful approach to ensuring fair trial rights while addressing serious criminal allegations.
