Court Upholds Governor's Rule But Pushes for Political Solution

The Gauhati High Court has delivered a significant verdict concerning the Chakma Autonomous District Council (CADC) in Mizoram, upholding the governor's rule while simultaneously advocating for a return to democratic processes through a floor test.

In a ruling that balances constitutional principles with practical governance needs, the Aizawl bench stated that while it found no grounds to interfere with the governor's rule imposed on July 7, 2025, political stability must be restored in the best interest of the CADC people.

Constitutional Validation of Governor's Authority

The court explicitly recognized the discretionary powers exercised by Governor Gen VK Singh under Paragraph 16(2) of the Sixth Schedule and Paragraph 20BB of the Indian Constitution. This constitutional backing came in response to challenges against the governor's rule implementation.

The CADC had been placed under governor's rule for six months starting July 7, 2025, following prolonged political instability and allegations of malpractice in appointments that drew opposition from various Chakma civil society organizations.

While disposing of writ petition No. 84 of 2025, the judiciary emphasized that the governor's decision fell well within constitutional boundaries, stating there was "no ground to interfere with the impugned order dated 07-07-2025".

Path Forward: Floor Test Recommended

In a crucial development, the High Court suggested that Governor Gen VK Singh consider conducting a floor test to determine majority support for a new council administration. This move aims to install a popular government that can function as envisioned by the Sixth Schedule provisions.

The court urged expedited action, noting that the governor should "consider taking the necessary steps as expeditiously as possible in the interest of justice, equity and favour" for the CADC population.

This recommendation acknowledges the need for democratic processes to resume while respecting the constitutional framework that initially necessitated the governor's intervention.

Durjya Dhan Chakma, former chief executive member and BJP district president for CADC, welcomed the court's judgment. He stated that the ruling reinforces democratic integrity while ensuring the unique administrative structure of CADC maintains clarity and stability.

Chakma emphasized that his party respects the court's decision and remains committed to working within constitutional provisions for public welfare. He expressed expectation that the governor will now take appropriate and timely steps regarding CADC's future governance.
