Calcutta High Court Dismisses BJP Bengal President's PIL on Voter Security
The Calcutta High Court on Wednesday dismissed a Public Interest Litigation (PIL) filed by BJP Bengal president Samik Bhattacharya, making a significant observation regarding electoral accountability. The court noted that Bhattacharya has "no authority on whether central or state agency will be accountable to ensure voters' security," effectively clarifying that such decisions rest solely with the Election Commission of India.
Court Directs Election Commission on Safety and Amenities
In its ruling, the division bench of the Calcutta High Court issued clear directives to the Election Commission. The bench emphasized the need for adequate safety arrangements at polling stations across the state. Additionally, the court mandated provisions for drinking water and other essential amenities to ensure a smooth and comfortable voting experience for all electors.
New Agency Appointed to Inspect Polling Booths
During the proceedings, the Election Commission informed the Calcutta High Court about a recent development in the oversight of polling infrastructure. A new organization, the NBCC, has been appointed to conduct a thorough examination of all polling booths in West Bengal. This inspection will assess whether each booth has sufficient security measures and necessary facilities in place for the upcoming elections.
The appointment of NBCC comes after Mackintosh Burn Limited, a state government undertaking, withdrew from carrying out the infrastructural work required for the polls. This change underscores the ongoing efforts to maintain transparency and efficiency in the electoral process, with the NBCC now tasked with ensuring that polling stations meet the required standards for safety and voter convenience.
The court's dismissal of the PIL reinforces the legal framework that places electoral security decisions under the purview of the Election Commission, rather than political figures.
