A court in Pilibhit has delivered a stern verdict in a disturbing case of child sexual abuse, sentencing a 42-year-old private tutor to 20 years of rigorous imprisonment for repeatedly assaulting a nine-year-old girl in 2021. The Additional District and Sessions Judge (POCSO) Geeta Singh pronounced the judgment, also imposing a penalty of Rs 50,000, which has been directed as compensation to the young survivor.

Following a written complaint by the girl's mother, an FIR was registered under multiple sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act. The charges initially included IPC sections 354A (sexual harassment), 354B (criminal force to woman with intent to disrobe), and 506 (criminal intimidation), along with POCSO Act sections 4 (penetrative sexual assault) and 5 (aggravated penetrative sexual assault).

Based on the survivor's medical examination report and statements recorded under CrPC section 164, IPC section 376AB (rape of a woman under 12 years of age) was later added to the FIR, reflecting the gravity of the offense.

Public Prosecutor Anil Kumar Sharma stated that the accused was arrested on February 9, 2021, and remained in custody as repeated bail pleas were rejected due to the severity of the crime. The court sentenced him to 20 years in jail under IPC section 376AB and the POCSO Act. In addition, concurrent sentences were awarded: three years under IPC section 354B, two years under section 354A, and one year under section 506. The convict was also ordered to pay a cumulative fine of Rs 21,000, on top of the Rs 50,000 penalty.

Non-payment of the POCSO penalty will result in an additional three months of imprisonment, ensuring strict enforcement of the financial penalties. The District Legal Services Authority has been instructed to facilitate the survivor's receipt of compensation from state government funds designated for such cases, providing some measure of support for her recovery.
