Lawyer Seeks Madras High Court's Suo Motu Intervention in Gang Rape of Minor Near Chennai
A lawyer has approached the Madras High Court, urging it to take suo motu cognisance of the gang rape of a 14-year-old girl that occurred near Chennai on Monday. On Wednesday, advocate A P Suryaprakasam made a mention before the first bench, comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G Arul Murugan, seeking an urgent hearing on the matter.
Advocate's Plea for Immediate Judicial Action
During the court proceedings, Suryaprakasam argued that the court must initiate suo motu proceedings due to the alarming frequency of such incidents being reported daily. He emphasized the gravity of the case, which involves the sexual assault of a minor girl, highlighting that the First Information Report (FIR) would not be publicly accessible, thereby necessitating judicial oversight.
Court's Response and Suggested Course of Action
When the bench inquired why suo motu cognisance was necessary, the advocate explained the sensitive nature of the issue and the restrictions on public access to the FIR. In response, the bench advised Suryaprakasam to file a formal petition to ensure the matter is properly considered and addressed by the court.
This development underscores ongoing concerns about child safety and judicial responsiveness in cases of sexual violence in the region. The incident has sparked calls for stronger legal mechanisms to protect minors and ensure swift justice in such heinous crimes.
