The commission found the establishment guilty of severe deficiency in service after a customer, an advocate, suffered physical harm to his teeth due to a plastic object embedded in his food. This case highlights critical issues of food safety and accountability in the hospitality sector.

Details of the Complaint and Incident

The complaint was filed by Balram Singh, an advocate practicing at the district courts in Ludhiana. According to his submission, on April 5, 2023, Singh visited the restaurant for lunch accompanied by his friend Gautam Chopra and two other associates. Shortly after the food was served, Singh began eating and immediately noticed that the taste was subpar. While chewing a butter naan, he allegedly encountered a hard plastic object that was embedded within the bread.

The plastic reportedly stuck to his teeth, causing immediate discomfort. When Singh brought this alarming issue to the attention of the restaurant staff, they initially denied the presence of plastic, falsely claiming it was merely a part of the food. However, after persistent objections from the complainant, the staff eventually admitted their fault, acknowledging the presence of the foreign object.

Escalation of the Conflict and Medical Aftermath

Following the incident, Singh attempted to meet the owner of the restaurant to address the matter, but the owner refused to come forward and speak with him. Subsequently, the manager and chef issued a written apology, but the situation deteriorated further. The restaurant staff then demanded excessive charges for the food, and when Singh refused to pay, they allegedly misbehaved and verbally abused him and his friends. Under duress, Singh ultimately paid Rs 2,625, including GST, which he described as an illegal and unjust amount.

The consequences of consuming the contaminated food were severe. Singh reported that the incident caused swelling in his mouth, rendering him unable to eat or speak properly for several days. He required medical treatment to address the physical injury and associated complications, underscoring the serious health risks posed by such negligence.

Legal Proceedings and Commission's Ruling

After the restaurant failed to resolve the issue amicably, Singh served a legal notice on June 13, 2023. Despite receiving the notice, the opposite parties did not take any steps to settle his claim or address the deficiency. Singh sought compensation of Rs 2 lakh, citing mental tension, harassment, and the physical harm suffered due to the restaurant's actions.

When the commission issued a notice to the restaurant, neither the owner nor the chef appeared before it, leading to them being proceeded against ex-parte. The complaint against the manager was dismissed as withdrawn. After thoroughly examining the evidence, including medical records and witness statements, the commission held that Singh's fundamental right to safety had been blatantly infringed.

The commission concluded that the acts and omissions of the owner and chef directly caused physical harm, mental agony, and shock to the complainant. This was deemed a clear case of deficiency in service and unfair trade practice under consumer protection laws. Consequently, the commission ordered both the owner and chef to pay a composite cost of Rs 10,000 to Singh within 30 days from the date of receiving the order.

Enforcement and Implications

The commission's directive stipulates that if the fine is not paid within the specified 30-day period, the restaurant will be liable to pay interest at a rate of 8% per annum from the date of the original complaint until actual payment is made.
