Kanpur Court Delivers Life Sentences in Heinous Murder Case
In a significant ruling, the Additional District and Sessions Judge of Kanpur Nagar, Sapna Tripathi, pronounced life imprisonment on Monday for three accused individuals convicted of murder and evidence destruction. The court found Rajesh Yadav, Rozi Yadav, and Govind alias Golu guilty of these grave offenses, marking a decisive moment in a case that has gripped the local community.
Court Imposes Financial Penalties and Compensation
The judicial decision included a fine of Rs 25,000 imposed on each of the convicted persons. In a detailed 63-page judgment, the court specified that Rs 40,000 from the total fine amount of Rs 75,000 should be allocated as compensation to the complainant. This financial aspect underscores the court's commitment to providing some measure of redress to the victim's family.
Background of the Case and Legal Arguments
The court had previously held the accused guilty of murder on April 2, with Monday's proceedings focused on determining the appropriate sentence. During the hearing, the defense counsel presented several mitigating factors:
- Rozi Yadav's gender as a woman
- The first-time offense status for Govind alias Golu, Rajesh Yadav, and Rozi Yadav
- All three accused had been in judicial custody since their arrest
Based on these points, the defense urged the court to adopt a lenient approach in sentencing and imposing fines.
Prosecution's Strenuous Arguments for Maximum Punishment
Contrasting sharply with the defense's position, Additional District Government Counsel Vinod Tripathi and the complainant's counsel argued vigorously for the most severe penalties. They emphasized that the accused had committed the brutal murder of the complainant's grandson, Sudhanshu, and had subsequently attempted to destroy evidence of the crime.
The prosecution highlighted Rajesh Yadav's prior criminal history, noting that he had previously been sentenced for the murder of his wife, who was Sudhanshu's mother. Despite the deceased not making any demands regarding property distribution, the accused proceeded with the killing. The prosecution characterized the offense as falling within the "rarest of rare" category, asserting that such acts are profoundly detrimental to society and warrant the harshest possible punishment.
In a particularly forceful submission, the ADGC argued that Rajesh Yadav should receive capital punishment, reflecting the extreme gravity of his actions.
Complainant's Heart-Wrenching Account
Complainant Shyam Babu provided a detailed narrative of the tragic events leading to the murder. He recounted that his daughter, Archana Yadav, married Rajesh Yadav in December 1996. Tragically, Rajesh and his parents were convicted of killing Archana in a dowry-related case and were sentenced to life imprisonment, though they were out on bail at the time of the subsequent events.
Following Archana's death, Shyam Babu took custody of her son, Sudhanshu alias Sunny, and raised him with care. During his bail period, Rajesh married Rozi Yadav and later attempted to regain custody of Sudhanshu, but Shyam Babu refused to relinquish the boy.
The accused managed to lure Sudhanshu by maintaining contact, and on June 6, 2022, they called him to their residence in Kanpur. Sudhanshu never returned from that visit. Shyam Babu later learned through various sources that the accused had poisoned Sudhanshu at Harjinder Nagar on the night of June 12-13, 2022, and had made efforts to dispose of the body to conceal evidence.
Discovery of the Body and Legal Proceedings
With assistance from police and family members, Shyam Babu intercepted the accused at Nagla Gude village, where they recovered Sudhanshu's body. The deceased exhibited visible injuries, a bluish discoloration, and froth around the mouth, all indicative of foul play. This grim discovery set the stage for the legal process that culminated in Monday's sentencing.
The court's ruling not only delivers justice for a horrific crime but also sends a strong message about the consequences of such violent acts in society.
