CBI Arrests Darwin Labs CTO in Rs 1,000 Crore GainBitcoin Crypto Scam Probe
The Central Bureau of Investigation (CBI) has made a significant arrest in its ongoing investigation into the massive Rs 1,000-crore GainBitcoin cryptocurrency scam. The accused, Ayush Varshney, was apprehended after being intercepted by immigration authorities at Mumbai airport while attempting to flee the country.
Details of the Arrest and Investigation
Ayush Varshney, identified as the co-founder and chief technology officer of Darwin Labs Private Limited, was a key alleged mastermind in the fraudulent scheme. He was intercepted on March 9 based on a look-out circular (LOC) issued by authorities and was subsequently handed over to the CBI, leading to his formal arrest on March 10. Varshney had been absconding, making this arrest a crucial development in the case.
The CBI took over the investigation following a Supreme Court mandate on December 13, 2023. The probe centers on a Ponzi scheme operated by Variabletech Pte Ltd, which allegedly duped thousands of victims by promising guaranteed high returns through a fraudulent cryptocurrency platform. Instead, investors' funds were systematically misappropriated, causing widespread financial losses.
Legal Charges and Technological Involvement
Legal proceedings against Varshney and other conspirators are being conducted under multiple sections of the Indian Penal Code, including 120B (criminal conspiracy), 406 (criminal breach of trust), and 420 (cheating), along with Section 66 of the Information Technology Act. According to the CBI, Darwin Labs Private Limited played a pivotal role by providing the technological backbone for the entire fraudulent enterprise.
Varshney, along with co-founders Sahil and Nikunj, who served as the chief capital officer of Vaomi AI, is accused of designing and deploying the "MCAP" token and its associated ERC-20 smart contract. Furthermore, the agency alleges that Darwin Labs was responsible for developing key components of the scam, including:
- The GBMinerscom mining pool
- The Bitcoin Payment Gateway
- The Coin Bank Bitcoin wallet
- The primary investor-facing website used to lure victims

The arrest marks a significant step in the CBI's effort to consolidate various FIRs related to the GainBitcoin fraud into a single, comprehensive investigation. The agency emphasized that the probe remains active as it continues to trace the misappropriated assets and examine the roles of other associates involved in the technological and financial architecture of the scam. This case highlights the growing challenges in regulating cryptocurrency schemes and the importance of robust investigative measures to combat financial fraud.
