Bengaluru High Court Mandates Committee Formation to Safeguard Sarakki Lake

The Karnataka High Court has issued a significant directive to protect Sarakki lake in JP Nagar, Bengaluru, from encroachments and environmental degradation. A division bench comprising Chief Justice Vibhu Bakhru and Justice CM Poonacha has ordered the state chief secretary to constitute a specialized committee dedicated to the lake's preservation and management.

Committee Composition and Immediate Actions

The court has specified that the committee must include key stakeholders to ensure comprehensive oversight. Members will include a representative from the Greater Bengaluru Authority (GBA), the deputy commissioner of Bengaluru Urban, a representative from the Tank Development Authority, and other relevant parties as deemed necessary. Additionally, the bench has mandated the appointment of a nodal officer from among these committee members to coordinate efforts.

The government order to establish this committee must be issued within three weeks, as per the court's instructions. This tight deadline underscores the urgency of addressing the encroachment issues that threaten the lake's ecosystem.

Responsibilities and Legal Framework

The committee's primary responsibilities will involve overseeing statutory authorities to initiate legal actions against encroachments in the buffer zone. This includes notifying individuals or entities responsible for unauthorized constructions and taking further measures to clear these encroachments in accordance with the law. The panel is also tasked with implementing other preservation strategies to protect the lake's integrity.

Within three months, the committee, through its nodal officer, must submit a detailed report to the court. This report should outline the actions taken to clear unauthorized constructions and other protective measures implemented. The division bench issued these directives while disposing of a Public Interest Litigation (PIL) filed by the Sarakki Lake Improvement Trust.

Background of the PIL and Environmental Concerns

The PIL, filed in 2023, highlighted ongoing illegal constructions at a site in Jagruthi Colony, Puttenahalli, JP Nagar 7th Phase. The petitioner sought judicial intervention to halt these activities, which pose a significant threat to the lake's buffer zone and overall health. Sarakki lake, a vital water body in Bengaluru, has faced increasing pressure from urban development, leading to concerns about water quality, biodiversity loss, and flood management.
