Bengaluru: Drunk Bikers Attack Police, Face BNS Charges

A Christmas night in Bengaluru turned violent when two brothers, allegedly intoxicated, assaulted police officers who had stopped them for riding a motorcycle the wrong way on a one-way street. The incident, which unfolded on Mysuru Road near Nayandahalli Junction, led to the arrest of the duo and their subsequent remand to judicial custody.

Wrong-Wide Ride Triggers Confrontation

The episode began around 11:50 PM on December 25 near Nayandahalli Junction. According to the official complaint, traffic constables Anil H.M. and Anil Kumar were setting up barricades when they spotted a Bajaj Pulsar (KA-25-HF-6616) coming from the direction of Nagarabhavi towards Nayandahalli, riding against the permitted flow of traffic. The bike reportedly came dangerously close to hitting the officers.

The rider, identified as 23-year-old Jayathirtha, showed clear signs of being under the influence of alcohol. The police immediately called for PSI Sandeep to arrive at the location with an alcometer and a PDA machine for documentation. While waiting, Jayathirtha began verbally abusing the constables and made a phone call, presumably seeking help.

Escalation and Violent Assault on Officers

Soon after the call, Jayathirtha's brother, 25-year-old Vishnu, arrived at the scene accompanied by a woman. The police reported that Jayathirtha admitted to being drunk but then tried to flee, pushing the officers and attempting to attack them. Constable Anil alerted the police helpline 112, prompting public members to intervene.

Despite the arrival of the Girinagar Hoysala-161 patrol vehicle, the brothers allegedly continued their abusive behavior and resisted the police. The situation escalated further around 12:45 AM when another Hoysala team reached the spot. In a brazen act, Vishnu reportedly grabbed the collar of Hoysala ASI Suresh B.H., dragged him, slapped him, and also kicked Constable Anil. PSI Sandeep and PSI Manjunath rushed to assist their colleagues. The woman present was instructed to leave the scene to prevent further complications.

Arrests and Legal Repercussions

The police faced significant difficulties but eventually managed to take both brothers into custody. A breathalyser test confirmed Jayathirtha's high level of intoxication, registering a reading of 185 mg/100 ml, far above the legal limit. This led to immediate charges for drunk driving and riding against a one-way street.

Based on the formal complaint filed by Constable Anil H.M., the Byatarayanapura police registered a comprehensive case under the new Bharatiya Nyaya Sanhita (BNS). The accused brothers face serious charges including:

  • BNS Section 121: Voluntarily causing hurt to deter a public servant from duty.
  • BNS Section 132: Assault or use of criminal force against a public servant.
  • BNS Section 351: Criminal intimidation.
  • BNS Section 352: Intentional insult with intent to provoke a breach of peace.

Both Jayathirtha and Vishnu, who work as electrical contractors and are residents of Nayandahalli, were arrested and later produced before a court, which remanded them to judicial custody. The case highlights the challenges faced by law enforcement on Bengaluru's roads and the stringent legal actions now applicable under the BNS for attacks on public servants.
