In a significant development, the US Supreme Court has struck down tariffs imposed by former President Donald Trump, a move that domestic industry and experts in India view as a source of relief. Originally, Trump had imposed a 50% tariff on Indian exports, but the recent court ruling has eliminated the 25% penal tariffs. With an interim agreement already finalized, the US is set to reduce the additional levy to 18%. This reduction comes as a welcome sign for Indian exporters, who had been grappling with increased trade barriers.
Saurabh Agarwal, tax partner at EY India, emphasized the positive implications of this "judicial correction." He stated that it strengthens India's hand in negotiations, allowing the country to focus on boosting its manufacturing sector without the immediate threat of arbitrary tariffs. Agarwal highlighted the importance of transitioning this momentum into a comprehensive Bilateral Trade Agreement that ensures reciprocal market access while protecting India's domestic priorities.
However, he noted that duties under Section 232 continue to affect key sectors such as steel, aluminum, and automobiles, indicating that challenges remain in specific areas.

The trade research body GTRI commented on the ruling's wider impact, suggesting that it should prompt India to re-examine its trade deal with the US. According to GTRI, the decision renders recent trade agreements initiated or concluded by the US with countries like the UK, Japan, the EU, Malaysia, Indonesia, Vietnam, and India as potentially one-sided and ineffective.
"Partner countries may now find reasons to abandon these deals," GTRI added, pointing out that the ruling reasserts Congress's primacy in trade policy. This shift is expected to curb presidential authority in weaponizing tariffs and reshape how future administrations use emergency economic powers.
