Tata Sons Chairman Expresses Anguish Over TCS Nashik Harassment Cases

Tata Sons chairman N Chandrasekaran, who also chairs Tata Consultancy Services (TCS), has described sexual harassment complaints emerging from the company's Nashik office as "gravely concerning and anguishing." He confirmed that a comprehensive investigation is currently in progress, spearheaded by TCS Chief Operating Officer Aarthi Subramanian, to "establish facts and identify all individuals responsible."

Immediate Action and Zero-Tolerance Stance

Chandrasekaran emphasized that action has already been initiated against the accused employees. Reiterating a firm zero-tolerance policy towards any form of coercion or misconduct by staff, he stated that stringent measures will be taken against those found guilty, alongside the implementation of corrective actions to prevent future occurrences.

Legal Proceedings and AGM's Custody Extended

In a significant development, the court of Additional Chief Judicial Magistrate J V Paliwal in Nashik extended the police custody of a TCS Assistant General Manager (AGM – Delivery Partner) until April 15. This AGM, who is also a member of the company's POSH (Prevention of Sexual Harassment) committee, faces charges of abetting sexual harassment by ignoring a staffer's complaint against two of the six arrested TCS employees.

A special investigation team (SIT) arrested the 51-year-old AGM from her Pune residence on April 10 and secured her custodial remand, which concluded on Monday. The SIT produced her before the magisterial court, seeking a further seven-day extension of her police custody for continued interrogation.

Evidence and Prosecution's Arguments

Public prosecutor Kiran Bendbhar informed the court that a senior manager at the TCS Nashik office had periodically communicated via emails to the AGM regarding complaints against the two employees accused of sexual harassment. The SIT has seized these emails, along with 78 additional emails and one chat recovered from the AGM's devices, all of which require analysis in her presence.

Furthermore, the police need to scrutinize the AGM's bank statements to determine if any financial transactions are linked to the case. The SIT's remand report alleges that despite being informed by the complainant about the harassment, the AGM took no action and even advised the complainant to "Let it go. Leave it," thereby emboldening the accused employees.

Assistant public prosecutor Aniket Avhand added that a review of the AGM's Call Detail Records (CDR) revealed 38 conversations with one accused person and another call with a second accused involved in related cases.

Defense Counterarguments

Defense lawyer V R Deshpande opposed the remand plea, arguing that his client has already provided all email details to the SIT and her physical presence is unnecessary for technical analysis. He also noted that the AGM cooperated with the SIT on March 31, days before the FIR was registered, after being summoned for inquiry.

Case Background and Broader Implications

On April 8, the Nashik police announced the arrest of six TCS employees. One faces charges of sexual exploitation under breach of marriage promise, while the remaining five are accused of sexual harassment and hurting religious sentiments of women colleagues over the past four years.

  • The initial rape case was registered on March 26 at Devlali Camp police station.
  • Eight subsequent cases, including the one involving the AGM, were filed later at Mumbai Naka police station.
  • Legal sections invoked against three accused in the AGM's case include sexual harassment, assault to disrobe, insulting modesty, abetment, defamation, and common intention.

Currently, all six accused employees are lodged in Nashik Road Central Prison under court custody, while the SIT continues to search for one more employee whose whereabouts remain unknown.

Administrative Scrutiny and Compliance Checks

Nashik district collector Ayush Prasad has directed the police and a district-level committee to investigate whether TCS has taken adequate measures in compliance with the POSH Act, highlighting the broader administrative and legal ramifications of this case.
