North Goa Consumer Commission Slaps SBI with Rs 2 Lakh Fine for Document Retention

In a significant ruling, the North Goa District Consumer Dispute Redressal Commission has mandated the State Bank of India (SBI) to pay Rs 2 lakh as compensation to Jose Rodrigues, a resident of Porvorim. The decision comes after the bank failed to return his property documents following the full repayment of his loan, a lapse spanning nearly two decades.

Details of the Compensation Award

The commission, led by President Bela Naik and members Auroliano de Oliveria and Rejitha Ranjan, awarded Rs 1.75 lakh for the physical and mental distress endured by Rodrigues and an additional Rs 25,000 to cover litigation expenses. This compensation underscores the severe impact of the bank's prolonged negligence on the complainant's well-being.

Bank's Conduct Deemed Negligent and Unfair

The bench strongly criticized SBI's actions, labeling them as negligent and in violation of standard banking protocols. It noted that the bank had accepted the original property documents when sanctioning the loan in 2002 and retained them without justification even after Rodrigues cleared his debt. The commission explicitly stated that SBI could not evade responsibility or refuse to return the documents post-repayment, finding the institution guilty of unfair trade practices.

Background of the Case

Jose Rodrigues, who operates a management consultancy firm, initially approached SBI in 2001 for financial assistance. In 2002, he was granted a loan of Rs 17 lakh after submitting his property papers as collateral. Although the debt recovery tribunal later reduced the claim amount and a one-time settlement was finalized, SBI neglected to return the documents despite issuing a no-dues certificate. This persistent failure compelled Rodrigues to seek redress through the consumer commission.

Commission's Directives to SBI

In addition to the financial penalty, the commission has ordered SBI to return all original property documents to Rodrigues within 30 days. This directive aims to rectify the long-standing oversight and restore the complainant's rightful ownership of his assets, emphasizing the importance of adherence to consumer protection laws in banking operations.
