A major controversy erupted after Gautam Dey posted on LinkedIn about being unable to travel to India to see his dying mother due to consular issues. Many users questioned his decision to remain in the US for 20 years on an H-1B visa, suggesting he prioritized money over family. Others, including Indian-origin entrepreneurs, defended him, highlighting systemic immigration challenges.
Backlash Over Priorities
Social media users criticized Dey for living in the US temporarily with his family while knowing the visa's limitations. They argued he chose financial stability over being with his mother in her final moments. Some experts, however, noted that many factors, such as Green Card delays, complicated his situation.
Support from Immigration Analysts
Immigration policy analyst Sam Peak stated, "If America is no longer a place where people feel empowered to be the best versions of themselves as they celebrate, struggle, and grieve, it ceases not just being the land of opportunity, but also the land of dignity and purpose."
Entrepreneur Calls Out Critics
Indian-origin entrepreneur Vijay Thirumalai defended Dey, explaining that the H-1B visa is a dual-intent visa with a path to Green Cards, now hindered by archaic country caps. He criticized those blaming Dey, saying, "All those talking about why he did that, H1B IS A DUAL INTENT VISA which is now in a mess because of Archaic country caps." Thirumalai warned that attacking H-1B holders could harm US tech dominance.
Dey's Heartfelt Post
Dey wrote in his LinkedIn post that he could not get a visa stamping appointment in India despite sending hospital documents to the Consulate. After 26 days of trying, his mother passed away. Traveling without an appointment would have prevented his re-entry to the US, forcing a months-long wait in India. Thousands of H-1B holders faced similar issues during the December holiday season.
Dey expressed his pain: "You do not have to measure success only by leaving home. Because no career dream should ever put you in a position where you must choose between your mother's final moments and your children's future. I lost that choice. And I will carry that pain forever." Despite this, many users accused him of choosing money over his mother.
Broader Implications
The incident highlights the struggles of H-1B visa holders, including long Green Card backlogs and limited visa appointments. It also raises questions about the balance between career aspirations and family obligations under temporary immigration status.
