The Haryana government on Monday informed the Punjab and Haryana High Court that authorities in Gurugram have issued nearly 2,000 notices to property owners for illegally covering stilt areas in violation of municipal norms. Additionally, around 500 restoration orders have been passed, directing violators to undo unauthorized constructions.
Court Proceedings
The submission was made before a division bench comprising Chief Justice Sheel Nagu and Justice Sanjiv Berry during the resumed hearing of a case. The court had earlier restrained the Haryana government from implementing the controversial 'stilt plus four floor policy' for residential plots in Gurugram under a notification dated July 2, 2024.
Arguments and Adjudication
During the hearing, counsels for the petitioners concluded their arguments, and the bench indicated that the case has reached final adjudication. The court clarified that the entire policy would remain subject to the outcome of the ongoing public interest litigation.
Panchkula Application
Meanwhile, the bench declined to extend the stay on the policy to Panchkula while hearing a separate application seeking similar restrictions. The petitioner argued that Panchkula was also facing issues due to the policy, similar to Gurugram. However, the court refused to intervene at this stage, noting that the impact of the policy across Haryana is already under detailed scrutiny of the court.
