The Lucknow bench of the Allahabad high court has called for comprehensive records concerning the process adopted for framing the Uttar Pradesh X-Ray Technicians Service Rules, 2024. The court has directed a senior officer from the personnel department, holding a rank not below that of special secretary, to appear before it on May 13 with all relevant documents.
Court Order on Petition
Justice Karunesh Singh Pawar issued the order while hearing a petition filed by Diwakar Singh. During the proceedings, Sunil Kumar Verma, the joint director in the medical health and services department, presented himself before the court.
Based on the records that were submitted, the state counsel informed the court that a decision had been taken on May 10, 2020, in compliance with a court order from 2019, and that the rules were subsequently framed accordingly. However, the court observed that the officer present was not fully acquainted with the specific process followed in framing the rules. Neither the officer nor the state counsel could provide a satisfactory explanation of the procedure that was adopted while formulating the rules.
Next Steps
Granting an additional two days for the production of the remaining records, the court ordered that a responsible officer from the personnel department must appear personally with the complete files. The court also directed the parties to present arguments on the maintainability of the petition at the next hearing date.
This development highlights the judiciary's scrutiny of administrative rule-making processes in the state of Uttar Pradesh.
