Thane MACT Awards Substantial Compensation for 2016 Digha Road Accident Involving Minor

In a significant ruling that brings closure to a prolonged legal battle, the Motor Accident Claims Tribunal (MACT) in Thane has awarded compensation of Rs 25.2 lakh to a young girl who suffered grievous injuries in a road accident nearly a decade ago. The tribunal, presided over by Member RV Mohite, has mandated that the amount carry an annual interest rate of 9% from the date the petition was filed until the full sum is realized.

Joint Liability and Timely Payment Directive

The tribunal has held both the car owner and the insurance company jointly and severally liable for the payment, ordering them to deposit the compensation within one month. The awarded amount must be placed in the tribunal's designated bank account and subsequently invested in a fixed deposit under the minor's name. This investment will remain locked until the girl attains the age of majority, ensuring the funds are preserved for her future needs and medical care.

Details of the Tragic 2016 Incident

According to the detailed tribunal order, the unfortunate accident occurred on February 16, 2016, at approximately 4:00 PM in the Ishwar Nagar area of Digha. The one-year-old girl was playing outside her residence at Annabhau Sathe Chawl when a car allegedly reversed at high speed without sounding its horn, knocking her down and causing severe injuries.

The child was initially rushed to Chhatrapati Shivaji Maharaj Hospital in Kalwa for emergency treatment. Due to the seriousness of her condition, she was later transferred to KEM Hospital in Parel for specialized medical attention and prolonged care.

Legal Proceedings and Medical Assessment

Following the incident, the Rabale MIDC police registered a First Information Report (FIR) under relevant sections of the Indian Penal Code and the Motor Vehicles Act. A charge sheet was subsequently filed against the driver involved in the accident.

The tribunal carefully examined the medical documentation presented, which revealed that the young victim underwent multiple hospitalizations and was assessed with a permanent physical impairment of 61%. However, after thorough evaluation of all evidence, the tribunal determined her functional disability to be 50% for compensation calculation purposes.

Importantly, the court noted that neither the driver nor the insurance provider could establish any contributory negligence on the part of the victim's family or prove a breach of policy conditions that would limit their liability.

Comprehensive Compensation Breakdown

The Rs 25.2 lakh award represents a comprehensive compensation package addressing multiple aspects of the victim's suffering and future challenges. The tribunal considered and included amounts for:

  • Loss of future income potential due to permanent disability
  • Medical expenses incurred during treatment and hospitalization
  • Pain, suffering, and trauma endured by the child
  • Special diet requirements during recovery
  • Conveyance costs for medical visits
  • Attendant charges for caregiving needs
  • Loss of marriage prospects due to disability
  • Compensation for the mother's lost income while caring for her daughter
  • Future medical expenses anticipated for ongoing treatment

This ruling underscores the judiciary's commitment to ensuring adequate compensation for victims of road accidents, particularly when minors suffer life-altering injuries. The detailed assessment of both economic and non-economic damages sets a precedent for similar cases involving permanent disability from vehicular accidents.
