The Supreme Court of India has raised serious concerns over the alarming increase in acid attack cases across the country and has urged the central government to consider enhancing the punishment for such heinous crimes. Court's Observations on Rising Cases
A bench comprising Justices emphasized that the number of acid attack incidents has been rising steadily, causing immense physical and psychological trauma to victims, predominantly women. The court noted that despite existing laws, the deterrent effect has been insufficient, necessitating a review of the punishment framework.
Need for Stringent Action
The Supreme Court highlighted that acid attacks leave victims with lifelong scars, both visible and invisible. The court asked the Centre to explore the possibility of amending the Indian Penal Code to provide for harsher penalties, including life imprisonment or even the death penalty in the most extreme cases. The bench also stressed the importance of strict implementation of laws regulating the sale of acid.
The court directed the government to file a response within four weeks, outlining its stand on enhancing punishment and improving victim compensation schemes. The bench further observed that the current maximum punishment of 10 years in prison may not be sufficient to deter potential offenders.
Government's Response
The central government, represented by the Solicitor General, assured the court that it would consider the suggestions seriously. The government informed the bench that it has already taken steps to tighten regulations on acid sales and has set up a fund for victim compensation. However, the court expressed dissatisfaction with the pace of implementation and called for a more robust mechanism.
The Supreme Court also directed all states and union territories to ensure that acid attack victims receive immediate medical care and compensation as per the law. The bench noted that delays in providing treatment and financial support often exacerbate the suffering of survivors.
Victim Rehabilitation and Support
The court emphasized the need for comprehensive rehabilitation programs for survivors, including medical treatment, psychological counseling, and vocational training. It asked the Centre and states to collaborate on creating a national database of acid attack victims to track their progress and ensure timely assistance.
The bench also suggested that the government launch awareness campaigns to educate the public about the severe consequences of acid attacks and the legal provisions against them. The court hoped that stricter punishments would act as a powerful deterrent and help curb this brutal crime.
