Portuguese National Transferred to Portugal After Goa Jail Term

In a landmark development for international judicial cooperation, a Portuguese national, who was serving a 15-year sentence in a high-profile narcotics case in Goa, has been transferred to his home country to complete the remainder of his prison term. This marks the first such transfer under a European convention involving a prisoner from the Colvale central jail.

The Transfer Under International Convention

Ivan Miguel Falcao Patricio was transferred to Portugal under the provisions of the Council of Europe’s Convention on the Transfer of Sentenced Persons. The move received official approval from the Indian Ministry of Home Affairs (MHA). Following the green light from New Delhi, the Portuguese government deputed two of its officers to escort the convict back to their country.

The logistical execution of the transfer saw a last-minute change. Initially planned for Goa, the handover was shifted to Mumbai upon a request from the Portuguese authorities. They cited difficulties in arranging direct flights to Goa, even with a stopover in a third country. The MHA subsequently coordinated with the Goa state government, which agreed to execute the transfer in Mumbai, where Patricio was formally handed over to the Portuguese officials.

The 2014 Mandrem Drug Bust: Case Details

The case dates back to 2014 in North Goa's Mandrem. Acting on a reliable tip-off, then ANC Police Sub-Inspector Dinesh Gadekar led a team to a local football ground. The information specified that a male foreigner, aged between 30-35 years with a fair complexion and average height, would arrive to deliver drugs to prospective customers.

The police team proceeded to the spot and soon identified Ivan Miguel Falcao Patricio approaching the ground. The officers swiftly surrounded him, introduced themselves, and informed him of the intelligence received. They then conducted a thorough search on his person.

The search yielded a significant haul of psychoactive substances:

  • One transparent autopress polythene packet containing a whitish-brownish crystalline substance.
  • One autopress polythene packet containing a whitish powder.
  • One whitish plastic bottle with a white cap containing a liquid.

Using a drug detection kit, the officers conducted field tests which confirmed the nature of the seized materials. The crystalline substance was identified as MDMA (commonly known as ecstasy), the whitish powder was cocaine, and the liquid in the bottle tested positive for LSD.

Following his arrest, Patricio was tried, convicted, and sentenced to 15 years of imprisonment. He served approximately 11 years of his sentence at the Colvale central jail in Goa before the transfer was initiated. His repatriation to Portugal allows him to serve the remaining part of his custodial sentence in his home country, closer to his family and social milieu, as per the objectives of the international convention which aims at the social rehabilitation of offenders.

This transfer sets a precedent for similar future cases involving foreign nationals sentenced in India, highlighting the growing framework of international legal cooperation in the administration of sentences and prisoner welfare.
