Mumbai Labourer Sentenced to Life for Brutal 2020 Hammer Attack
A sessions court in Mumbai has delivered a decisive verdict, convicting and sentencing a 45-year-old labourer to life imprisonment for the brutal 2020 murder of a man and the attempted murder of an eyewitness, both carried out with an iron hammer. The court imposed an additional fine of Rs 10,000 on the accused, Subal Choudhary, also known as Bangali, emphasizing the clear lethal intent behind the violent assault.
Details of the Fatal Altercation in Kurla Chawl
The tragic incident unfolded in the early hours of August 19, 2020, at Indira Nagar in Kurla. According to the prosecution's case, an eyewitness, Ayaz Khan, heard a loud quarrel and discovered Choudhary and the victim, Javed Siddiqui Shaikh, engaged in a physical confrontation. When Khan attempted to intervene and mediate, the situation escalated dramatically.
Choudhary retrieved an iron hammer from beneath a kitchen platform and launched a vicious attack, striking Shaikh repeatedly on the head. As Khan tried to stop the assault, he too was attacked with the same weapon. While Khan managed to flee the scene and seek help, Shaikh was found unresponsive and later succumbed to his severe injuries at Sion Hospital.
Court Rejects Self-Defence Plea, Cites Medical Evidence
During the trial, the defence argued that Choudhary had acted in self-protection, claiming that Shaikh and Khan had entered his home with the intent to commit theft and had initiated the assault. However, the judge firmly rejected this plea, highlighting the disproportionate and extreme nature of the violence.
The court placed significant weight on the medical evidence, which detailed multiple fractures and crushed brain matter, findings that were starkly inconsistent with a claim of self-defence. In its observation, the court stated, "The nature, number and seat of injuries clearly indicate intention or knowledge that such injuries were sufficient in the ordinary course of nature to cause death."
