Mother Files Appeal in Bombay High Court Over Acquittal in Daughter's Murder Case
In a significant legal development, the mother of murder victim Jhanvi Kukreja has approached the Bombay High Court to challenge the acquittal of her daughter's friend, Diya Padalkar, in the case. The case dates back to a tragic incident that occurred on January 1, 2021, following a New Year's Eve party on the terrace of a building in Khar West, Mumbai. Jhanvi Kukreja, a 19-year-old psychology student from Santacruz, was found dead in a pool of blood on the ground floor of Bhagwati Heights. The post-mortem report revealed she had suffered a staggering 48 injuries.
According to allegations presented during the trial, the incident unfolded after a fight allegedly broke out among three individuals—Jhanvi, Shree Jogdhankar, and Diya Padalkar. The altercation reportedly stemmed from Jogdhankar's intimacy with Padalkar. It was claimed that Jhanvi was dragged down the stairs from the fifth floor during the confrontation.
The Sessions Court Verdict and Subsequent Appeal
On January 31 of this year, the sessions court delivered its judgment in the case. The court convicted and sentenced 26-year-old Shree Jogdhankar to life imprisonment for the murder of Jhanvi Kukreja. However, in a controversial decision, the court acquitted 24-year-old Diya Padalkar, granting her the "benefit of doubt" and clearing her of all charges.
Dissatisfied with this outcome, Jhanvi's mother, Niddhi Kukreja, filed an appeal in the Bombay High Court on March 21 through her advocate, Trivankumar Karnani. In her appeal, Niddhi Kukreja has contended that the trial court erred in its appreciation of evidence against Padalkar, despite her alleged presence at the crime scene.
