Madras High Court Dismisses Bail Plea in Real Estate Extortion Case, Highlights Political Interference

The Madras High Court has dismissed the bail petition of a couple arrested for allegedly cheating and threatening a real estate promoter in Madurai. Justice K K Ramakrishnan observed that some politicians and political intermediaries exert undue influence over real estate promoters, criminally intimidating them into executing sale deeds for flats at prices substantially below the prevailing market value.

Case Details and Allegations

The court was hearing the bail petition filed by Jai Balaji and his wife, Kalavathi, who were arrested by the Central Crime Branch of Madurai city police in February. According to the prosecution, complainant Seetharaman, a real estate promoter, was developing a layout project near Ponmeni in Madurai in 2024.

Jai Balaji allegedly approached Seetharaman, claiming he wielded considerable political influence and had close acquaintance with the former mayor of Madurai corporation and her husband. Balaji also asserted that he was the personal assistant to a sitting minister.

Balaji promised to obtain necessary permissions and infrastructural facilities for the project, including underground sewage connection, common road access, and drinking water connection. It is alleged that he obtained a sum of 50 lakh rupees from the complainant and secured sale deeds for two flats at a reduced value in his and his wife's names.

When Balaji failed to fulfil his promises, Seetharaman lodged a police complaint, leading to the couple's arrest.

Court Observations on Political Pressure

Justice Ramakrishnan noted that some politicians and political intermediaries compel promoters to pay illegal gratification. Promoters are forced to execute and register sale deeds for meagre consideration. However, after obtaining registration, the concerned individuals allegedly fail to fulfil the promises made at the time of execution.

The judge observed that the petitioners projected themselves as close associates of the then mayor of Madurai corporation. By wielding such purported political influence, they extracted money from the complainant and obtained sale deeds for consideration far below the market value.

Additional Threats and Criminal History

Following the registration of the criminal case, the petitioners are alleged to have instigated their associates to threaten the complainant to withdraw the complaint, resulting in another FIR. Balaji is also involved in another economic offence involving large-scale cheating of the public.

Considering the objections raised by the prosecution and that the investigation is at a nascent stage, the judge dismissed the couple's bail petition.

Anticipatory Bail Petitions of Associates

The court was also hearing the anticipatory bail petitions of the couple's associates—Saravanasundar, M Ramakrishnan, P S S Bagyalakshmi, and A Nagalingam. They allegedly trespassed into the complainant's house and criminally intimidated him to withdraw the complaint.

This case underscores the broader issue of political interference in real estate transactions, as highlighted by the Madras High Court, which continues to monitor such exploitative practices in the industry.
