Lucknow High Court Overturns Magistrate's Decision in Domestic Violence Case
The Lucknow bench of the Allahabad High Court has taken a significant step in a domestic violence case by quashing an order from a magistrate court. This order had previously rejected a woman's plea to compel her husband to produce proof of his income and details of his property. The High Court has directed the magistrate court to reconsider the woman's application afresh, setting a strict deadline of six weeks for this reevaluation.

In its ruling, the High Court emphasized the critical role of disclosing actual income in cases related to maintenance and domestic violence. The court stated that to ensure fair proceedings, the magistrate court possesses the authority to force the husband to provide comprehensive details of his income and property by issuing an appropriate order. Background of the Case and Judicial Proceedings
The order was passed by a bench led by Justice Brij Raj Singh, following a petition filed on behalf of the woman and her minor son. The woman had initially approached the additional chief judicial magistrate (ACJM), first, in Lucknow, as part of an ongoing case under the Domestic Violence Act. She accused her husband and in-laws of dowry harassment, physical assault, and financial torture. Citing Section 91 of the BNSS, she requested that her husband be ordered to submit his income tax returns and other financial documents.
However, on January 19, 2026, the ACJM, first, rejected this application, prompting the petitioners to challenge the decision in the High Court. During the proceedings, the High Court summoned the husband's income tax returns for the past two years. The records revealed that the husband, who described himself as a labourer in court, is actually an architect with an annual income of approximately Rs 5 lakh.

The High Court referenced the Supreme Court verdict in the case of Rajnesh versus Neha to support its decision. This precedent establishes that a husband can be legally required to provide necessary documents to accurately disclose his income and assets in such matters.
