Additional Sessions Judge Harshal Kisan Bhalerao pronounced the judgment on Thursday, holding Sharif Rajjak Shaikh guilty under Sections 302 (murder) and 307 (attempt to murder) of the Indian Penal Code. The court imposed a life sentence for the murder charge and ten years of rigorous imprisonment for the attempted murder. Both sentences will run concurrently, ensuring the convict serves a substantial prison term.

Background of the Fatal Confrontation

Assistant Public Prosecutor Sanjay Pawar detailed the case chronology. Sharif Rajjak Shaikh was engaged to 18-year-old Nazmin Shaikh in 2018. However, the engagement was later cancelled by Nazmin's family because of Shaikh's concerning behavior. On July 23, 2019, Shaikh confronted Nazmin and her mother, Faimida Shaikh, in a lane near their residence in Ganesh Peth. Armed with a knife, he launched a vicious attack, stabbing both women multiple times.

Nazmin succumbed to her injuries during treatment, while Faimida survived but sustained serious wounds. The Faraskhana police registered a case against Sharif, leading to his arrest on July 27, 2019. He has remained in judicial custody since that time.

The prosecution built a strong case based on multiple corroborative pieces of evidence:

  • Eyewitness Testimony: The court placed significant reliance on the testimony of the victim's mother, Faimida Shaikh. She consistently identified Sharif as the assailant throughout the trial, and her cross-examination failed to discredit her statement.
  • Medical and Forensic Proof: Medical reports confirmed that Nazmin died from hemorrhagic shock resulting from multiple stab wounds. Forensic analysis revealed that blood stains matching both the deceased and the injured mother were found on the clothes Sharif was wearing at the time of his arrest.
  • Recovery of Weapon and Neighbor's Account: The knife used in the attack was recovered from the crime scene. Furthermore, a neighbor testified that Nazmin named Sharif as her attacker immediately after the incident, adding crucial corroboration.

Court Addresses Defence Arguments

The defence raised questions about the absence of fingerprints on the recovered knife. The court, however, observed that in cases involving repeated stabbing, the weapon is often handled in a manner that reduces the likelihood of retaining clear fingerprints. This reasoning was accepted, and the court found the overall evidence compelling.

Judge Bhalerao concluded that the prosecution had proved its case beyond a reasonable doubt, leading to the conviction and the subsequent imposition of the life sentence. This ruling underscores the judiciary's commitment to delivering justice in cases of violent crimes against women.
