Kapur Family Trust Feud Escalates as Widow Removes Mother-in-Law as Trustee
The bitter dispute within the family of late businessman Sunjay Kapur over control of assets has taken a dramatic turn, intensifying the legal and familial conflict. Days after Sunjay's mother, Rani Kapur, sought the removal of her son's wife, Priya Sachdev Kapur, as a trustee of the RK Family Trust, Priya has now retaliated by removing her mother-in-law from the trust.
Legal Notice Alleges Breach of Fiduciary Duties
In a sharp legal notice served to Rani Kapur, Priya Sachdev Kapur cited what she described as a breach of fiduciary duties and conduct adverse to the interests of the Trust and its beneficiaries. Priya, acting in her capacity as both a trustee and beneficiary of the RK Family Trust, asserted that Rani's actions have compromised the trust's integrity.
The notice stated, "By challenging the very validity of the Trust and seeking to divest the Trust of all its assets, you have disregarded the Trust completely and have set up an interest in the Trust assets wholly inconsistent with the interests of the beneficiaries as well as the Trust Deed, thereby rendering you incapacitated to continue functioning as a Trustee of the Trust."
Formal Removal and Effective Date
Pursuant to Clause 8.11 of the Trust Deed, Priya formally removed Rani as a trustee, effective March 25, 2026. This action strips Rani of all authority, rights, and locus to act on behalf of the Trust. Specifically, she is barred from interfering in its administration, participating in trust meetings or actions, dealing with any trust properties, or accessing trust documents, data, or financial reports.
Allegations of Actions Against Trust Interests
In her legal notice, Priya alleged that Rani began acting against the interests of the Trust and its beneficiaries immediately after Sunjay Kapur's sudden demise on June 12 last year. The beneficiaries listed include Priya herself, Master Azarias Suri Kapur, and Sunjay's other children from his previous marriage, Ms. Samaira Kapur and Master Kiaan Kapur.
Priya had previously issued a cease-and-desist notice to Rani on January 10 this year, citing actions contrary to the Trust Deed's terms. Despite this, Rani initiated proceedings before the High Court of Delhi, asserting that the Trust is null, void, and unenforceable while claiming exclusive personal ownership over the trust assets.
The notice further elaborated, "In fact, it is a matter of record that you have sought the nullification of the acts performed in accordance with the Trust since its inception, and restitution of the Trust assets to you in your personal capacity, amongst other reliefs, which are wholly detrimental to the interests of the beneficiaries."
Escalation and Future Challenges
The matter is poised to intensify further, with Rani Kapur likely to challenge the removal decision. This ongoing feud underscores deep-seated familial tensions and legal complexities surrounding the management and control of the RK Family Trust's assets.
