Junagadh Court Delivers 20-Year Sentence in Minor Rape Case
A court in Junagadh has handed down a significant verdict, sentencing a 26-year-old man to two decades of rigorous imprisonment for the rape of a 15-year-old girl in 2021. The judgment underscores the legal system's firm stance on crimes against minors.

The incident occurred in the early hours of May 12, 2021. According to the prosecution, the accused, Ajay Gohel, a laborer residing in Dolatpara who worked at the same mill as the victim, contacted the girl around 2:30 AM. He asked her to meet him outside her house and then took her on his motorcycle to the Bhavnath Road area. There, he established physical relations with her against her will. The following afternoon, he dropped her off near the booking office of a private bus service.
Initially, the victim's mother filed a complaint of kidnapping and molestation. During the investigation, police uncovered that the girl had also been raped. At trial, the defense argued that the victim accompanied Gohel willingly and that they were in a romantic relationship, which her mother opposed due to their different faiths. However, the court acquitted Gohel of kidnapping and abduction charges under IPC Sections 363 and 366, noting that the prosecution failed to prove he forcibly took her from her guardian's custody.
Court's Ruling and Legal Basis
The court emphasized that a minor's consent holds no legal validity. Relying on the victim's testimony, corroborating medical evidence, and her established age of 15 years and two months at the time of the crime, the court found Gohel guilty under IPC Section 376(3) and relevant sections of the Protection of Children from Sexual Offences (Pocso) Act. District government pleader N K Purohit highlighted this in the proceedings.
For the primary offence, Gohel was sentenced to 20 years of rigorous imprisonment and fined Rs 10,000. Recognizing the severe mental trauma suffered by the girl, the court also directed the District Legal Services Authority to provide Rs 4 lakh in compensation under the Gujarat Victim Compensation Scheme. Seventy-five percent of this amount is to be placed in a fixed deposit for three years, while the remaining 25% will be deposited directly into her bank account.
