Hyderabad: Speech-Impaired Woman with Disabilities Raped by Neighbour, Swift Police Action Leads to Arrest

In a deeply disturbing incident in Hyderabad, a 28-year-old woman who is speech-impaired and has learning difficulties was allegedly raped by her neighbour at her home on Saturday. The Attapur police have demonstrated commendable efficiency by arresting the accused, a 35-year-old daily-wage labourer, within 48 hours of the assault, based on a complaint filed by the survivor's family.

Details of the Alleged Assault

The incident unfolded on Saturday morning when the survivor was left alone at home. Her father and elder brother had gone out for work, and her sister-in-law had left for a local bank. Seizing this opportunity, the accused, who is also a relative of the survivor, entered the house.

He gagged the woman and proceeded to violate her. Around 11:10 am, the sister-in-law returned home to find the survivor naked, with the accused present at the scene. The accused hurriedly put on his clothes and attempted to flee.

The sister-in-law immediately raised an alarm and tried to intercept him, but according to police reports, the accused managed to escape from the spot initially.

Communication and Police Investigation

The survivor, who is speech-impaired with a physical disability, described the assault to her sister-in-law through signs and gestures, stated Deputy Commissioner of Police (DCP), Rajendranagar, S Sreenivas. This crucial communication enabled the family to understand the gravity of the situation and take immediate action.

Based on the sister-in-law's complaint, a case was registered under Section 64(2)(f)(k) of the Bharatiya Nyaya Sanhita, which specifically addresses rape by a relative or guardian on a person with disability. This legal provision underscores the severity of crimes against vulnerable individuals.

Arrest and Legal Proceedings

Police acted swiftly and arrested the accused on Monday in Attapur. The survivor has been sent for a medical examination to gather forensic evidence, which is critical for the prosecution. The accused is set to be produced before the court, where he will face charges under the stringent sections of the Bharatiya Nyaya Sanhita.

Broader Implications and Community Response

This case highlights several pressing issues:

  • Vulnerability of Persons with Disabilities: The incident underscores the heightened risks faced by individuals with speech impairments and learning difficulties, who may struggle to communicate or seek help during emergencies.
  • Role of Family and Community: The quick response by the sister-in-law was instrumental in initiating police action, emphasizing the importance of vigilant family members and neighbours.
  • Legal Framework: The application of the Bharatiya Nyaya Sanhita in this case demonstrates the legal system's evolving approach to protecting disabled persons from sexual violence.

Authorities have urged the public to report any suspicious activities and support vulnerable community members. The arrest within 48 hours serves as a reminder of the police's commitment to addressing such heinous crimes promptly, though it also raises questions about safety measures for disabled individuals in residential areas.
