Jharkhand High Court Directs Resolution of Dhanbad Court Parking Dispute

The Jharkhand High Court has taken decisive action to address the ongoing parking conflict at the Dhanbad Civil Court. A division bench comprising Chief Justice M S Sonak and Justice Rajesh Shankar has issued specific directives to facilitate a resolution between the legal community and local authorities.

Court Orders Joint Meeting in Judge's Chamber

On March 12, the high court bench directed the Dhanbad Principal District and Sessions Judge to arrange a joint meeting in his chamber. This meeting aims to resolve the dispute between lawyers and the district administration regarding parking arrangements for advocates' vehicles at the Dhanbad Civil Court premises.

The court has mandated the participation of key officials including the Dhanbad Deputy Commissioner and Senior Superintendent of Police, along with representatives from the Dhanbad Bar Association. All parties have been ordered to actively engage in the joint meeting to find a workable solution to the parking problem.

Background of the Parking Conflict

The dispute originated from a petition filed by the Dhanbad Bar Association before the high court. The association highlighted the significant difficulties faced by advocates due to inadequate parking facilities at the civil court. Currently, the court lacks suitable parking space, forcing lawyers to park their vehicles on the campus of the adjacent Sadar Hospital and along the roads outside the court premises.

This haphazard parking arrangement has created persistent traffic problems in the area. Vehicles parked without proper organization frequently cause traffic jams, disrupting the flow of vehicles and creating inconvenience for court visitors, hospital patients, and local residents alike.

Legal Representation and Proposed Solution

High Court Advocate Shailesh Kumar Singh, representing the Dhanbad Bar Association, presented the case before the division bench. He emphasized the urgent need for a collaborative approach to address the parking crisis. Singh specifically requested that a joint meeting be convened between the lawyers' association and district administration to explore potential solutions.

The high court accepted this proposal and issued clear instructions for the joint meeting. The court directed that the district administration officials, members of the bar association, and Advocate Shailesh Kumar Singh should all participate in discussions with the Dhanbad Principal District Judge. The objective is to find an amicable and practical resolution to the parking problem that has been affecting court operations and local traffic.

Next Steps and Future Hearing

The case has been scheduled for further hearing on April 23, 2024. This gives the involved parties approximately six weeks to conduct the joint meeting and develop a proposed solution. The high court will review the progress made during the next hearing and may issue further directions based on the outcomes of the joint discussions.

This judicial intervention represents a structured approach to resolving what has become a persistent administrative and logistical challenge. By bringing together all stakeholders in a formal setting under judicial supervision, the high court aims to facilitate a comprehensive solution that addresses both the parking needs of legal professionals and the traffic management concerns of the district administration.
