A tragic incident in Gurgaon has once again highlighted the perilous working conditions faced by labourers in the city's construction sector. A 32-year-old painter lost his life after falling from the fifth floor of a residential building in Sector 42 on Tuesday. The police have registered a case against the contractors involved, citing the absence of basic safety measures at the worksite as the primary cause.
Details of the Fatal Incident
The deceased has been identified as Avdhesh Nishad, a resident of Gorakhpur in Uttar Pradesh. He was employed as a painter at a house under construction in Sector 42. According to the police report, Avdhesh had gone to the site along with a fellow painter, Ranvijay, to carry out exterior painting work.
The sequence of events, as described in the complaint filed by Avdhesh's brother, Akash, reveals a shocking lapse in safety protocols. Ranvijay was reportedly descending from the rooftop using a rope swing to paint the outer wall. Avdhesh was stationed on the roof itself, holding the rope with the assistance of a ladder to secure his colleague.
During this hazardous operation, both the rope and the ladder allegedly slipped. This catastrophic failure caused both men to plummet from the fifth floor to the ground below.
Aftermath and Legal Action
The fall resulted in critical injuries for Avdhesh Nishad. He was rushed to Paras Hospital, where doctors declared him dead upon arrival. His body was sent for an autopsy to determine the exact cause of death. Ranvijay survived the fall but sustained injuries and is currently undergoing treatment.
Following the complaint, the Gurgaon police have taken swift legal action. A First Information Report (FIR) has been registered against the contractors responsible for the worksite. The case has been filed under relevant sections of the Bharatiya Nyaya Sanhita (BNS), including:
- BNS Section 106 (Causing death by negligence)
- BNS Section 290 (Negligent conduct with respect to building activities)
- BNS Section 3(5) (Common intention)
