Delhi High Court Orders Tamil Magazine to Remove Defamatory Content Against Isha Foundation

In a significant legal development, the Delhi High Court has issued an interim order directing Tamil media outlet Nakkheeran to remove defamatory content published against Sadhguru Jagadish Vasudev's Isha Foundation. The court highlighted an element of malice in the magazine's conduct, emphasizing the need to balance freedom of speech with the right to reputation.

Court's Findings on Defamatory Content

Justice Subramonium Prasad, in the order made public recently, stated that the contents of the impugned videos are per se defamatory and directly harm the reputation of the Isha Foundation in the eyes of the public. The court examined a series of videos and articles cited by the foundation in its defamation suit filed in 2024 against Nakkheeran and its editor.

The court noted that the publication of eleven videos, which have collectively garnered over 50 lakh views and thousands of comments, indicates a malicious intent. It described the titles as click-bait, designed to lure audiences with unfounded comparisons involving the foundation's founder.

Balance Between Free Speech and Reputation

Stressing that reputation is integral to individual dignity, the court underscored the importance of balancing freedom of expression with the right to protect one's reputation. It found that the content transcends the boundary of fair criticism and should be injuncted to prevent irreparable harm to the Isha Foundation.

The court further detected a ulterior political agenda in the defendants' actions, aimed at maligning the trust. It warned that such online content could cause significant reputational damage that cannot be compensated monetarily.

Interim Take-Down Order and Legal Implications

In its interim order, the Delhi High Court directed Nakkheeran to immediately take down the defamatory videos and articles from all social media platforms. It also restrained the magazine from uploading similar content in the future, citing that the balance of convenience lies in protecting the foundation's reputation.

The lawsuit alleged that Nakkheeran published defamatory, vulgar, and obscene content to harm the Isha Foundation and Sadhguru, including accusations of exploitation and brainwashing. The court's decision marks a pivotal moment in addressing online defamation and safeguarding institutional integrity against malicious attacks.
