The Delhi High Court has issued a stern directive to police authorities, emphasizing the need for "extra caution" to maintain a peaceful atmosphere during the upcoming Eid festivities in Uttam Nagar. This instruction comes in the wake of a tragic incident where a 26-year-old youth lost his life during a clash on Holi, raising concerns about potential communal tensions.

Court's Emphasis on Preventive Measures

During a hearing on Thursday, a bench comprising Chief Justice D K Upadhyaya and Justice Tejas Karia reviewed the security arrangements for the area. The court stressed that police must ensure the situation does not take an "ugly turn," highlighting that events in Delhi often have a ripple effect across the region. "Whatever happens in Delhi has a ripple effect, please don't be lax," the bench told police counsel, underscoring the importance of robust bandobast (security arrangements) that instill a sense of safety among all community members.

The High Court pointed out that Eid is a "pious occasion" meant for celebration, and it is the duty of authorities to prevent any disruption from vandalism or hooliganism. The bench directed that heavy police presence should continue in Uttam Nagar until Ram Navami to prevent any mischief that could lead to untoward situations.

Background of the Public Interest Litigation

The court was addressing a Public Interest Litigation (PIL) filed by the Association for Protection of Civil Rights, a civil rights group that expressed fears of "imminent communal violence" during Eid in Uttam Nagar. The petition cited the March 4 death of the youth as a trigger for these apprehensions, urging judicial intervention to ensure peace.

The PIL alleged that the Holi incident was communalized through coordinated dissemination of inflammatory content, crowd mobilization, and organized protests. Senior advocate Nitya Ramkrishnan, representing the petitioner, raised concerns about hate speech incidents on March 15, where individuals openly called for violence against the Muslim community without police action. She referenced Supreme Court directives mandating immediate FIR registration for hate speech, noting that no such cases were filed.

Police Response and Security Deployments

Standing counsel for Delhi Police, Sanjay Lao, provided detailed assurances to the High Court regarding security measures. He confirmed that adequate police personnel from Dwarka district, along with 400 additional armed force personnel from Delhi Police and 400 central armed police forces, have been deployed to ensure incident-free Eid celebrations.

Key security initiatives include:

  • Round-the-clock police arrangements in Uttam Nagar JJ colony and neighboring areas since March 5.
  • Preventive actions and the presence of armed police companies in all 11 areas under Dwarka district police stations.
  • Hundreds of police personnel on constant vigil.
  • Removal of 50 inflammatory posts from social media platforms and requests to take down approximately 170 more.
  • Extensive verification of over 8,000 individuals in the area.
  • Formation of "peace committees" at every police station and 30 meetings with religious leaders in the past two weeks.

Additional solicitor general Chetan Sharma, representing the Centre, described the area as "saturated with security" and praised police efforts. The court acknowledged these measures but reiterated that if assessments indicate a need for stronger arrangements, authorities must act promptly.

Call for Community Restraint and Harmony

The High Court emphasized that maintaining peace is a shared responsibility. "The situation as described in the petition not only calls upon authorities to be at constant strict vigil but it also calls upon members of different sections of society to maintain restraint and conduct themselves in a manner which may promote peace and harmony," the bench stated. It urged all community members to avoid actions that could escalate tensions, particularly in light of past incidents.

The court's directives aim to prevent similar violence during Eid, ensuring that celebrations proceed without disruption.
