CCPA Cracks Down on Unfair Surcharges in Hotel and Restaurant Bills

The Central Consumer Protection Authority (CCPA) issued a firm warning to hotels and restaurants on Wednesday, threatening strict action if they continue to levy additional charges such as "LPG charges," "gas surcharge," or "fuel cost recovery" on food bills. This advisory invokes provisions of the Consumer Protection Act to address what the authority describes as an unfair trade practice designed to circumvent existing guidelines on service charges.

Unfair Practices Under Scrutiny

The CCPA highlighted that grievances reported through the National Consumer Helpline (NCH) and media coverage reveal a troubling trend. Certain establishments are automatically adding these extra fees to consumer bills, over and above the displayed menu prices and applicable taxes. The authority emphasized that input costs, including fuel, LPG, electricity, and other operational expenses, are inherent to running a business and must be integrated into the pricing of menu items from the outset.

According to the advisory, the price shown in the menu should be the final price, exclusive only of taxes. Consumers should not be misled or forced to pay any additional charges that are not voluntary. This move aims to protect consumers from hidden fees and ensure transparency in billing practices.

Consequences and Consumer Recourse

Violations of this directive may result in strict penalties, as the CCPA considers such actions a breach of consumer rights. To empower consumers, the authority outlined steps they can take if they encounter these unfair charges:

  • Request the hotel or restaurant to remove the unauthorized charge from the bill immediately.
  • Lodge a complaint by calling the National Consumer Helpline at 1915 or through its dedicated mobile application.
  • File a formal complaint before the appropriate consumer commission via the e-Jagriti portal for further legal action.

This advisory reinforces the CCPA's commitment to upholding fair trade standards and safeguarding consumer interests in the hospitality sector.
