Chennai: The Tamil Nadu government has officially declared the Trichy East Assembly constituency vacant following the resignation of Chief Minister C. Joseph Vijay, who had won the seat in the recent elections. The declaration was made through a gazette notification issued by former Speaker M. Appavu on May 10.
Vijay's Decision to Retain Perambur
Joseph Vijay, who contested from both Trichy East and Perambur constituencies, chose to retain the Perambur seat. As per constitutional provisions, he submitted his resignation letter for Trichy East to the former Speaker, M. Appavu.
Legal Basis for Vacancy Declaration
The gazette notification cited Article 190(3)(b) of the Indian Constitution, under which Appavu accepted Vijay's resignation. The seat is considered vacant from the date of resignation, as per the notification.
Next Steps: Election Commission to Conduct Bypoll
The official notification will now be forwarded to the Election Commission of India (ECI). The ECI is mandated to conduct a by-election for the Trichy East constituency within six months from the date of vacancy. This ensures that the seat does not remain unrepresented for an extended period.
