Kerala Police File Case Against IUML Leader for Alleged Election Bribery
In a significant development in Kerala's election landscape, Tirur Police registered a case late on Saturday night against Indian Union Muslim League (IUML) state vice-president C P Bava Haji. The case centers on allegations that Haji offered a 15-day foreign trip to panchayat committee office-bearers who secure the highest lead for United Democratic Front (UDF) candidate V S Joy in the Thavanur assembly constituency.
Legal Framework and Complaint Details
Tirur Police filed the case under Section 173 of the Bharatiya Nyaya Sanhita (BNS), which pertains to bribery, and Section 123(1) of the Representation of the People Act, 1951. This section prohibits any gift, offer, or promise of gratification by a candidate, agent, or any person with their consent during elections. The complaint was formally submitted by the returning officer of the Thavanur assembly constituency, initiating the legal proceedings.
Evidence and Judicial Review
Sources indicate that the Tirur sub-collector, who also serves as the returning officer, provided a detailed report to the police along with a video recording of Haji's speech. Since the alleged offence is classified as non-cognisable, the Tirur judicial first class magistrate court conducted a review on Saturday. Following this examination, the court directed the police to officially register the case and commence a thorough enquiry into the matter.
District-Level Scrutiny and Viral Video Impact
Malappuram district collector Vinay Goyal has taken proactive steps by instructing the district police chief to investigate whether Haji's speech, delivered at Mangalam on March 22, violates the model code of conduct and existing election laws. This directive came after the video of the speech went viral on social media platforms, drawing widespread attention and raising concerns about electoral integrity.
Alleged Offer and Political Context
C P Bava Haji, a prominent businessman with interests in Gulf countries, reportedly offered to personally sponsor return air tickets to the United Arab Emirates (UAE) and a 15-day stay for selected panchayat office-bearers. This offer was allegedly made as an incentive to boost the electoral performance of UDF candidate V S Joy in the Thavanur constituency, which is currently witnessing a tight contest between incumbent Left-backed Independent MLA K T Jaleel and Joy.
Defense from UDF Leaders
In response to the allegations, several UDF leaders have come forward to defend Bava Haji. They argue that his speech was intended to motivate party workers rather than influence voters directly, and therefore does not constitute a violation of the poll code. This defense highlights the ongoing debate over the interpretation of election laws and the boundaries of political campaigning.
The case underscores the heightened scrutiny on election conduct in Kerala, with authorities taking swift action to address potential breaches. As the enquiry progresses, it will likely have implications for the electoral dynamics in Thavanur and broader political discourse in the state.
