Goa High Court Informed of Electoral Officer Transfer in Canacona Municipal Elections
The Goa High Court received a significant update on Monday regarding the upcoming municipal council elections in Canacona. Advocate General Devidas Pangam informed the court that Deputy Collector Prataprao Gaunkar, who was appointed as the Electoral Registration Officer (ERO) for these elections, will be transferred from his position within the next two days.
Petition Challenges Appointment on Conflict of Interest Grounds
The statement came during proceedings for a petition that challenged Gaunkar's appointment as ERO. The petition was filed by sitting councillor Shubham Komarpant, who was represented by advocate Om D'Costa. The primary grounds for the challenge were allegations of conflict of interest.
Komarpant argued that Gaunkar, as a voter within the same municipal area and a relative of another sitting councillor, could not impartially perform his duties as Electoral Registration Officer. This role involves assisting the State Election Commissioner in dividing Canacona's municipal wards for the elections, a process that requires absolute neutrality.
Transfer Details and Resolution
In response to the petition, Advocate General Pangam outlined the state's plan to address the concerns. Prataprao Gaunkar will be transferred to the position of Vasco Deputy Collector. Concurrently, Bhagwant Karmali, the current Deputy Collector of Vasco, will be posted as the new Deputy Collector of Canacona.
This administrative reshuffle is designed to eliminate any perceived conflicts and ensure the integrity of the electoral process. The petition itself has a procedural history: Gaunkar was appointed as ERO in February 2024. On March 6, Komarpant filed a written objection with the State Election Commissioner (SEC), followed by the high court petition citing inaction from the SEC.
With the state's commitment to transfer the officer, the grievance was effectively addressed. Consequently, the petition was dismissed as withdrawn, bringing this legal challenge to a close. This case highlights the importance of transparency and impartiality in electoral administration, particularly at the municipal level where local connections can raise legitimate concerns.
