Badaun Court Clears SP MP Dharmendra Yadav and 28 Others in 2022 Election Code Violation Case
In a significant legal development, an MP-MLA court in Badaun, Uttar Pradesh, on Thursday acquitted Samajwadi Party MP from Azamgarh and former Badaun MP Dharmendra Yadav, along with 28 other individuals, in a case concerning alleged violations of the model code of conduct during the 2022 Uttar Pradesh assembly elections. The court ruled that the charges could not be substantiated, leading to the acquittal of all accused parties.
Background of the Case and Legal Proceedings
The case originated in 2022 when an FIR was registered at the Civil Lines police station against Yadav and others. The allegations centered on the distribution of gifts to influence voters, a practice prohibited under election laws. According to Jagat Singh, Yadav's counsel who spoke to TOI, the FIR also invoked provisions of the Epidemic Diseases Act, citing concerns during the election period amidst health protocols.
The FIR included charges under multiple IPC sections:
- Section 171F: Punishment for undue influence or personation at an election.
- Section 171H: Illegal payments in connection with an election.
- Section 269: Negligent act likely to spread infection of disease dangerous to life.
- Section 270: Malignant act likely to spread infection of disease dangerous to life.
Yadav appeared before the court earlier this week after receiving a notice from the additional sessions judge of the MP-MLA court. He was accompanied by his legal counsel and several Samajwadi Party leaders, highlighting the political significance of the case.
Court's Decision and Previous Rulings
After hearing the submissions from both sides, the court concluded that the evidence presented was insufficient to prove the charges, resulting in the acquittal of all 29 accused. This decision follows a prior ruling by a lower court on June 28, 2024, which had also acquitted Yadav and the others. However, an appeal was subsequently filed in the sessions court, which admitted the plea and issued fresh notices, leading to the latest hearing and reaffirmation of the acquittal.
The case underscores the complexities of election-related legal battles and the challenges in proving model code violations, particularly when intertwined with public health concerns during the pandemic era.
Implications and Broader Context
This acquittal may have political ramifications, as it clears a prominent Samajwadi Party figure of legal hurdles ahead of future elections. It also raises questions about the enforcement of election codes and the legal thresholds for proving such violations, especially in scenarios involving multiple accused and cross-referenced laws like the Epidemic Diseases Act.
The outcome highlights the judiciary's role in scrutinizing election-related allegations and ensuring due process, while also reflecting on the broader electoral integrity framework in Uttar Pradesh, a state known for its intense political contests.
