Delhi Court Imprisons Congress MLA in Forgery and Bank Fraud Case
A Delhi court on Thursday delivered a significant verdict, sentencing Congress' Datia MLA Rajendra Bharti and co-accused Raghuvir Sharan Prajapati to three years of simple imprisonment in a document forgery and bank fraud case. This judgment came just one day after the court found both individuals guilty of conspiring to cheat a cooperative bank while occupying positions of responsibility.

The court imposed a substantial fine of ₹1 lakh each on both convicts, explicitly stating that this amount would be utilized as compensation for the bank that suffered the financial loss. During the sentencing proceedings, the defense presented compelling arguments for leniency.
For MLA Rajendra Bharti, his legal team emphasized his current status as a sitting legislator who is serving his third term as an elected representative. The defense stressed that Bharti carries significant public responsibilities and duties toward his constituents. Additionally, they highlighted his medical condition, noting that Bharti is a heart patient who recently underwent treatment at a Delhi hospital.
Regarding co-accused Raghuvir Sharan Prajapati, the defense focused primarily on his advanced age as a mitigating factor in the case. After considering these arguments, the court decided to suspend the sentence for a period of two months, during which time both convicts retain the right to file an appeal against the judgment in an appropriate appellate court.

The legal case centers on a fixed deposit transaction dating back to 1998 that was opened in the name of Bharti's mother, Savitri Shyam. According to the complaint filed by Zila Sahkari Krishi Aur Gramin Vikas Bank, the accused individuals conspired to manipulate and alter official bank records.
Their alleged scheme involved unlawfully extending the fixed deposit tenure from the original three-year period to an extended fifteen-year duration. This manipulation was designed to enable them to draw substantially higher interest payments on a fixed deposit amounting to Rs 10 lakh that was held in his mother's name at the cooperative bank.
Political Ramifications and Legal Strategy
The court's verdict has generated substantial political turbulence within Madhya Pradesh's political landscape. The state unit of the Congress party has announced its intention to challenge the court order in the higher judiciary. This legal battle assumes particular significance as it unfolds just two months before crucial Rajya Sabha elections in the state.
The Madhya Pradesh Congress, which is contesting one out of three available Upper House seats, cannot afford to lose another critical vote in the legislative assembly. Party insiders have revealed that Congress' Rajya Sabha MP and distinguished legal expert Vivek Tankha is being approached to file the appeal against the order in the high court.
Rajendra Bharti, who achieved a notable electoral victory by defeating former home minister Narottam Mishra in the 2023 assembly elections, was formally convicted and subsequently sent to Tihar jail on Wednesday following the court's guilty verdict.

With three Rajya Sabha seats from Madhya Pradesh scheduled for election in June-July, the Congress party plans to wage a comprehensive legal battle to protect Bharti's legislative membership and voting privileges. Last month, voting rights were suspended for Congress MLA Mukesh Malhotra from the Vijaypur assembly constituency following a High Court order concerning his election affidavit. Malhotra had previously defeated BJP minister Ram Niwas Rawat in a bypoll conducted in November 2024.
In another development, Congress MLA Nirmala Sapre from the Bina seat joined the BJP during the 2024 Lok Sabha elections but has not yet received primary membership from the ruling party. Technically, she remains a Congress legislator despite regularly attending BJP functions, and her anti-defection case is currently pending before the High Court.

Madhya Pradesh Congress president Jitu Patwari issued a strong statement regarding the court's decision, characterizing it as "a planned conspiracy by the BJP to attack the basic principles of democracy and harass opposition party MLAs and elected representatives."
Patwari emphasized that the Congress party is treating this matter with utmost seriousness and plans to engage top Supreme Court lawyers to vigorously contest the case through the judicial system. The party leadership views this legal development as part of a broader pattern of political targeting ahead of important legislative elections.
