Telangana High Court Takes Up Former Police Officer's Appeal
The Telangana High Court has formally admitted an appeal filed by a former police sub-inspector. This officer faced termination from service following serious rape allegations made against him. The court action represents a new chapter in a disturbing case that has drawn significant attention.
Court Proceedings and Allegations
A division bench comprising Chief Justice Aparesh Kumar Singh and Justice GM Mohiuddin admitted the appeal on January 9. The bench then decided to adjourn the matter. It will be listed for hearing after a period of eight weeks. This gives both sides time to prepare their legal arguments thoroughly.
The core of the case involves allegations from a woman head constable. She served as a subordinate to the former sub-inspector. Her complaint states that the incident occurred in June 2024. She alleges the SI threatened her with his service revolver at gunpoint. The alleged sexual assault took place in a guest room located near the Laxmi pump house of the Kaleshwaram project.
The survivor's account includes further serious claims. She stated the accused had made a previous attempt to assault her. Furthermore, she alleged he had sexually assaulted three other woman constables. These additional claims paint a picture of repeated misconduct.
Background of the Case and Legal Challenge
The alleged incident happened while both individuals were posted at the Kaleshwaram police station. This station is in the Jayashankar Bhupalpally district. Following the registration of the rape case, police authorities terminated the sub-inspector's service.
The former officer then challenged this termination in the High Court. His initial petition argued the termination process violated due process. He claimed it ignored the principles of natural justice. However, a single judge of the High Court examined the case and upheld the termination order. The judge ruled against the former policeman.
Not accepting this defeat, the former cop approached the division bench. He filed an appeal challenging the single judge's order from December 2025. In his appeal, the 50-year-old officer detailed his service record. He joined the police force as a constable back in 1993. He earned a promotion to the rank of sub-inspector in 2018, after years of service.
Arguments Presented in the Appeal
The appellant's legal arguments focus on procedural fairness. He alleges the authorities did not conduct a proper disciplinary inquiry. Instead of a fair and transparent process, they imposed a major punishment directly. The authorities justified this by claiming the victims might not come forward to testify openly. Fear could prevent them from speaking out against a fellow officer.
The former sub-inspector contends his termination was erroneous. He also challenges the single judge's agreement with the authorities' stance. The judge had noted the practical impossibility of conducting an enquiry given the serious nature of the allegations. The appellant urges the division bench to set aside both the termination order and the single judge's ruling. He seeks a chance to clear his name through what he views as a just legal process.
The Telangana High Court's decision to admit this appeal ensures the legal battle will continue. All eyes will now be on the proceedings scheduled for eight weeks from now. The outcome could have implications for disciplinary procedures within the police force.
