In a landmark ruling, a special Pocso court in Surat has sentenced a 17-year-old boy to 20 years of rigorous imprisonment for the rape and impregnation of a 12-year-old girl in 2023. This case represents the first instance in Surat where a minor has been handed the maximum punishment under the Protection of Children from Sexual Offences (Pocso) Act, setting a significant precedent in juvenile justice.

Details of the Case and Legal Proceedings

The accused, originally from Uttar Pradesh but residing in the Sachin GIDC area, befriended and developed a relationship with his 12-year-old neighbor in 2023. He repeatedly raped her, leading to her pregnancy. The matter came to light when the girl missed her period and disclosed the relationship to authorities. A complaint was promptly filed under the Pocso Act and the Juvenile Justice Act, resulting in the minor's arrest and placement in a juvenile home.

During the trial, public prosecutor Munjal Brahmbhatt presented compelling arguments, supported by medical evidence and the victim's testimony. He emphasized that despite being a minor, the accused exhibited an adult mentality in committing such a heinous act, and thus, the case warranted the strictest penalties under the law.

Court's Verdict and Rationale

Special judge Vinod V Parmar, after thorough consideration of arguments from both sides and the evidence, ruled that the accused had committed a despicable act against a child, violating neighborly trust. The judge noted that the accused, aged between 16 and 18 at the time, repeatedly raped the young girl, making the crime particularly severe.

To set an example and deter similar offenses, the court deemed it necessary to impose a severe sentence. Consequently, the boy was sentenced to 20 years of rigorous imprisonment. He has been sent to the Mehsana Zonal Observation Home, where he will remain until the age of 21, after which he will be transferred to Lajpore Jail in Surat.

Ongoing Monitoring and Implications

The court has mandated that the child development officer at the observation home submit a report to the Surat court every six months until the accused turns 21. This ensures continuous oversight of his rehabilitation and compliance with the sentence.
