Orissa High Court Grants Interim Bail to Life Convict for Daughter's Exam Support

In a compassionate judicial move, the Orissa High Court has granted interim bail to a convict serving a life sentence, allowing him to assist his minor daughter during her ongoing High School Certificate (HSC) Examination. The decision underscores the court's sensitivity to familial responsibilities amidst legal proceedings.

Court's Order and Background of the Case

A division bench comprising Justices Manash Ranjan Pathak and Sibo Sankar Mishra issued the order on Monday while hearing an interlocutory application filed by the prisoner. The convict, in his 40s, was convicted in 2021 for a murder case registered at Jagatsinghpur police station in 2010. He is currently serving rigorous imprisonment for life in a Jagatsinghpur jail and has challenged his conviction in a criminal appeal pending before the High Court.

Seeking temporary release, the convict informed the court that his 16-year-old daughter is appearing for the HSC exams from February 19 to March 2. He highlighted that she resides in their native village with her elderly grandparents, aged 76 and 70, and faces significant difficulties commuting to the exam centre, located approximately 5 kilometers away.

Police Inquiry and Court's Observations

Acting on the court's direction from February 18, the inspector in-charge of Jagatsinghpur police station conducted a local inquiry and submitted a report on February 20. The report confirmed the girl's exam schedule, verified the genuineness of her admit card, and noted that no adverse antecedents were found against her father beyond the current case.

Taking note of the police report and the advanced age of the grandparents, the bench observed that the circumstances warranted interim relief. The court emphasized the need for parental support during critical academic periods, balancing legal rigor with humanitarian considerations.

Terms of Bail and Future Proceedings

The court directed the sessions judge of Jagatsinghpur to release the convict on interim bail until March 10, starting from the date of his release. This bail is subject to terms and conditions deemed appropriate by the authorities. The convict has been instructed to surrender immediately after the bail period and file a surrender certificate. Subsequently, the criminal appeal will be listed for hearing after March 10.
