The case originated when activists from the Public Action Committee filed an application with the National Green Tribunal, alleging repeated encroachments on designated green spaces by various authorities including the Municipal Corporation, Ludhiana Improvement Trust, and Greater Ludhiana Area Development Authority. The application specifically identified illegal construction activities in greenbelt zones along Old GT Road near Buddha Dariya, adjacent to the Sarabha Nagar Zone-D Office of MC, Model Town Extension, and several other parks throughout the city.

On July 31, 2025, the NGT disposed of the initial matter after forming a joint committee comprising the regional officer of MoEF&CC, the member secretary of the Punjab Pollution Control Board, and the district magistrate serving as the nodal agency. This committee was mandated to verify whether the identified areas were officially earmarked as green spaces and, in cases of confirmed encroachments, to implement both remedial and punitive measures within a strict three-month timeframe while submitting a detailed action taken report to the Tribunal.

Continued Non-Compliance and Escalating Violations

Despite the clear directives and the passage of more than six months, the joint committee completely failed to execute the Tribunal's orders. No substantive action was initiated by the concerned authorities, prompting activists to submit multiple representations to the district magistrate on September 14, 2025, and January 10, along with an email addressed to all committee members on November 21, 2025. All these communications went unanswered, with no corrective measures undertaken.

Activists Kapil Arora and Amandeep Bains revealed that, in the absence of any enforcement action, fresh construction activities have reportedly commenced for a tehsil office within the same greenbelt along Old GT Road. This new development represents a blatant violation of environmental laws, master plan provisions, and binding directions issued by both the Supreme Court and the National Green Tribunal, necessitating immediate judicial intervention.

Legal Consequences and Tribunal's Firm Stance

The complainants emphasized that the issuance of notices by the NGT underscores the Tribunal's unwavering stance against administrative apathy and sends a clear, unequivocal message that continued defiance of environmental protection orders will invite strict legal consequences. Taking serious note of this persistent and willful non-compliance, the Public Action Committee members filed an execution application before the Tribunal, seeking enforcement of the original directives.
