In a significant development, the Nashik City Police conducted a covert operation for nearly a month at the Tata Consultancy Services (TCS) Business Process Outsourcing (BPO) unit in Nashik, Maharashtra. Plainclothes officers, including women constables, interacted with staff to gather intelligence, leading to the registration of nine First Information Reports (FIRs) and the arrest of seven employees, including a senior Human Resources official.

Complaint Triggers Discreet Probe into Religious Influence and Harassment

The investigation was initiated after a complaint from the family of a Hindu woman in her early twenties, who alleged she had begun adopting Islamic practices due to workplace influence. Concerned about changes in her lifestyle related to faith, her family prevented her from attending work, prompting authorities to launch a discreet probe into the 147-employee facility.

Police assured the complainants of full cooperation and safety, deploying officers in plainclothes to the unit. Based on their findings, the first FIR was registered at Deolali police station in March, accusing a colleague of rape, concealment of marriage, and establishing a relationship under false pretenses of marriage. Provisions related to hurting religious sentiments were also invoked, with police claiming the accused influenced her religious practices. This led to two initial arrests.

Probe Widens as More Victims Come Forward with Serious Allegations

As the investigation expanded, more employees, predominantly women aged 18 to 25, came forward with allegations of sexual harassment, coercion, and religious pressure. Many were initially hesitant but filed complaints after learning of the arrests. Between March 26 and April 3, nine FIRs were registered across Deolali Camp and Mumbai Naka police stations.

Charges under the Bharatiya Nyaya Sanhita (BNS) include rape, sexual harassment, stalking, outraging modesty, and deliberate acts to outrage religious feelings. Seven FIRs contain similar allegations, such as inappropriate touching, sexually coloured remarks, pressure linked to personal or religious choices, and claims that workload increased if advances were resisted.

Arrests Include Senior Staff and HR Official; SIT Investigates POSH Compliance

So far, seven individuals—six men and one woman—have been arrested, while another female accused remains absconding, with police tracking her using technical and intelligence inputs. The arrested include team leaders, senior staff, and an Assistant General Manager (delivery partner), who has been booked for allegedly ignoring complaints despite being part of the company’s internal Prevention of Sexual Harassment (POSH) mechanism.

A Special Investigation Team (SIT) headed by Assistant Commissioner of Police (Crime) Sandeep Mitke is probing all nine cases. The SIT is examining whether TCS complied with mandatory provisions under the POSH Act, including the functioning of an Internal Committee. Police have recovered 78 emails and chat transcripts from the AGM’s digital devices, which are being analyzed, along with her bank statements to check for financial transactions linked to the case.

Defence and Corporate Responses Highlight Divergent Perspectives

Lawyers for the accused have dismissed the charges as exaggerated and misinterpreted. Advocate Baba Sayyad argued that casual workplace interactions and voluntary behavior are being criminalized, stating that wearing traditional attire during festivals or discussing religion does not amount to conversion, and compliments or personal conversations should not be treated as criminal acts.

In contrast, TCS has responded strongly, suspending the employees named in the case and reiterating its zero-tolerance policy towards harassment and coercion. Tata Sons Chairman N Chandrasekaran termed the allegations "gravely concerning and anguishing," announcing a detailed internal investigation under Chief Operating Officer Aarthi Subramanian. The company is fully cooperating with law enforcement and promises stringent action based on findings.

Political Reactions and Operational Impact at Nashik Facility

The case has triggered political reactions and claims of "organized conversion," though police officials have stated they have found no evidence of a larger conspiracy so far. Protests have been staged outside the Nashik facility by political groups demanding strict action, leading to slowed operations with minimal staff presence reported during visits.

Police clarified that any decision on shutting or relocating the office rests solely with TCS, and authorities have not ordered closure. With multiple FIRs, cross-complaints, and an absconding accused, the SIT is expected to widen its probe further, examining internal corporate processes and HR accountability mechanisms.

The victim's identity has not been revealed to protect their privacy as per Supreme Court directives on cases related to sexual assault.
