Justice Deepak Khot, presiding over the case, ruled that the state government possesses the legal right to recall or withdraw its own notifications.

Background of the Case

The notification in question was initially issued on January 5, 2005, granting exemption to the Dev Dattatreyaa temple trust from the Public Trust Act. However, just weeks later, on January 24, 2005, the government recalled this exemption. The priest contested this recall, arguing that the government lacked the authority to reverse its earlier decision.

Court's Ruling

Justice Deepak Khot, while dismissing the petition, held that the government was well within its legal rights to recall the notification. The court emphasized that the power to issue a notification inherently includes the power to withdraw or modify it, provided the action is not arbitrary or illegal. In this case, the court found no violation of legal principles.
